Short Term Rentals. Short term rentals shall comply with the follow:
(a) No person shall permit, allow, or offer a dwelling unit to be used as a short term rental nor enter into a short term rental agreement concerning a dwelling unit without first obtaining a permit from the Village of Linndale pursuant to the requirements of this Ordinance.
(1) All short-term rental owners shall obtain liability insurance for each short-term rental. Each short-term rental shall at all times maintain insurance coverage and provide proof of insurance.
(b) Standards for Approval.
(1) Multi-family dwelling units shall not be utilized as short-term rentals.
(2) Only the property owner of record as listed in the Cuyahoga County Auditor records at the time of registration may register a short-term rental. The property owner must be at least 18 years of age.
(3) The registration permit number shall be listed within the property description on any advertisement for the short-term rental and posted inside the property in a conspicuous location.
(4) Mobile homes, RVs, travel trailers, tents, vehicles and similar non-permanent structures may not serve as short-term vacation rentals.
(5) A short-term rental may only be used for overnight accommodations and shall not be used for a cultural event, wedding, private event, special or sales event, bachelor or bachelorette party or other similar party or activity.
(6) A short-term rental shall comply with all residential property requirements including but not limited to solid waste management, noise, and zoning & public safety ordinances and Ohio Building Code Standards.
(7) In no event shall an individual room in a dwelling unit be rented to a person, family, or other group of persons as short term rental. Nor shall an occupant of a short term rental sublet a portion of a dwelling unit.
(8) Exterior signs identifying the property as a short-term vacation rental are prohibited.
(9) Maximum overnight occupancy for short term rentals shall be up to a maximum of two (2) persons per sleeping room or bedroom, plus two (2) additional persons per property, up to a maximum of six (6) persons, excluding children under three (3) years of age.
(10) There shall be a maximum of four (4) bedrooms or sleeping rooms.
(11) There shall be one covered (1) on-site parking space for a dwelling unit with up to two (2) bedrooms or sleeping rooms and two covered (2) on-site parking spaces for a three (3) or four (4) bedroom dwelling unit. Larger dwelling units must demonstrate adequate parking with a minimum of three covered (3) spaces. A short-term rental shall not generate more traffic or different types of vehicle traffic than a home occupied by a permanent resident.
(c) Rent, Fee or Occupancy Charge or Other Consideration. A property shall be considered a short term rental whether or not a fee, occupancy charge or other consideration is paid by the occupant(s) of the short term rental or whether the rent, fee or occupancy charge is paid by some other person or entity on behalf of the occupant(s).
(d) Penalty. Violation. Anyone who violates any provision of this section shall be charged with a misdemeanor in the first degree and each day the violation exists may be construed as an additional offense.
