147.05 SICK LEAVE.
   (a)    Accumulation and Earning Rate.  
      (1)   Sick leave shall be earned at the rate of one day per month of full time service, or twelve days per year of full time service. Sick leave credit shall be prorated for partial months of service. Unused sick leave shall accrue without limitation. (Ord. 2007-14. Passed 4-3-07.)
      (2)   A.   Current part time employees will not accumulate sick time benefits after the date of passage of this subsection.
         B.   Part time employees currently who have prior accumulation of sick time will be able to use those hours, but will not accumulate more.

   (b)    Use of Sick Leave. An employee may use sick leave for absence due to:
      (1)    Personal illness, injury or exposure to contagious disease where quarantined by the Board of Health.
      (2)    Illness in the immediate family, with a maximum of twelve eight hour days per year. The term immediate family in case of illness, shall be interpreted as meaning parents, parents of spouse, spouse and children of the employee, regardless of place of residence, as well as any other relatives living in the employee's home.
      (3)    For each death in the immediate family, a maximum of five eight hour work days, including travel time. The term "immediate family" in case of death, shall be interpreted as meaning parents, parents of spouse, brothers or sisters of the employee or employee's spouse and children of the employee, regardless of place of residence, as well as other relatives in the employee's home.
   (c)    Proof of Absence. The Mayor or Department Head may require that an employee furnish the Village with a satisfactory affidavit to the effect that the absence taken was caused by illness or due to any of the foregoing permissible causes.
   (d)    Return to Full Time Duty. An employee who has been absent for three days or more, due to illness shall be required to present a statement from a physician validating that they are physically able to resume their duties on a full time basis. Where an employee has been absent for less than three days, the Mayor or Department Head may, at his discretion, request such a statement from the employee or his physician, before permitting the employee to return to work.
   (e)    Payment of Sick Leave. Sick leave is to be paid only for the causes set forth in subsection (b) hereof, and, where applicable, upon presentation of satisfactory proof of absence. Sick leave is not to be used for any other purpose, for example, vacation, personal reasons, or early retirement.
   (f)    Unused Accumulated Sick Leave. Unused accumulated sick leave credit may be converted by an employee at the time of his retirement from the Village employment by reason of either service retirement or disability retirement, as those terms are defined in Ohio R.C. 124.39 or upon the death of the employee while actively employed by the Village. Payment to qualifying employees shall be at the rate of the employee's pay at the time of retirement or death, shall be in the amount of one-fourth of the unused accumulated hours of sick leave, and, in no instance, shall exceed in value thirty days of the employee's pay at his prevailing rate at the time of his retirement or death.
