(a) “False alarm” means an emergency alarm activated and to which the Police Department responds which is not in response to actual or attempted burglary, holdup, aggravated assault, unlawful entry or other bona fide emergency requiring immediate police response. False alarms include negligently or accidently activated alarms; alarms which are activated to off- premises locations by certain noise levels which alarm is communicated to the Police Department and the same is the result of a mistaken belief that an unlawful entry or other emergency is about to occur; alarms which are the result of faulty, malfunctioning or improperly installed or maintained equipment; alarms which are the result of improperly installed, secured or maintained windows, doors or similar general areas of the building; and alarms which are purposely activated to summon the police in nonemergency situations.
False alarms shall not include alarms willfully activated by alarm subscribers or users that are on the premises where the alarm is installed, upon good faith belief that an actual or attempted burglary, holdup, aggravated assault, unlawful entry or other bona fide emergency is about to occur, when the cause has been proven to be an act of God, or malfunction caused by testing or repairing of telephonic lines maintained and operated by public utilities under the regulation of the Public Service Commission.
(b) "Alarm system" means any assembly of equipment, mechanical or electrical, arranged to signal the occurrence of an illegal entry, holdup, aggravated assault or other bona fide emergency at a premises requiring an immediate response to the scene by the Police Department.
(c) "Subscriber" means any user who employs the services of a central alarm system.
(d) "User" means any person owning, using and/or operating an alarm system.
