§ 35.37 OFFENSE COMMITTED BY OWNER, LESSEE OR PERSON IN CHARGE.

   The owner, lessee or other person in charge of any conveyance or place described in this subchapter commits an offense:

   (A)   If he or she fails to have prominently displayed a reasonable sized notice that smoking is prohibited by state law in such conveyance and/or place; or

   (B)   If he or she fails to have such conveyance or place equipped with facilities for extinguishing of smoking materials.
