§ 97.01 FIRE CODE ADOPTION.
   (A)   The Village of Linden adopts by reference Chapters COMM 14 and COMM 30 of the Wisconsin Administrative Code, and National Fire Protection Association 1 Uniform Fire Code and documents adopted by Chapter 2 thereof as if fully set forth herein as the fire code of the village.
   (B)   The fire code shall be enforced by the Chief of the Fire Department and such personnel as he or she may designate. The Chief of the Fire Department or his or her designee is hereby authorized to issue citations for violations of the municipal code which are directly related to their official responsibilities.
   (C)   The Chief of the Fire Department may a variance to the provisions of the fire code upon application in writing by the owner or lessee, or his duly authorized agent, when there are practical difficulties in carrying out the strict letter of the code, provided the spirit of the code shall be observed, public safety secured and substantial justice done. The particulars of such modifications when granted or allowed and the decision of the Chief of the Fire Department thereon shall be entered upon the records of the Department and a signed copy shall be furnished the applicant.
   (D)   Whenever the Chief of the Fire Department shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the code do not apply or that the true intent and meaning of the code has been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Chief of the Fire Department as provided under Wis. Stats. Chapter 68, within 30 days from the date of the decision of the appeal.
