§ 73.02 ALL-TERRAIN VEHICLES AND UTILITY TERRAIN VEHICLES AND ROUTES.
   (A)   Purpose. The purpose of this section is to establish all-terrain vehicle (“ATV”) and utility terrain vehicle (“UTV”) routes in the village and regulate the operation of all-terrain and utility terrain vehicles in the village.
   (B)   Operation of all-terrain vehicles and utility terrain vehicles. Operation of ATVs and UTVs shall be subject to all provisions of Wis. Stats. § 23.33, as the same may be amended from time to time.
   (C)   Designation of all-terrain vehicle and utility terrain vehicle routes. The designated all-terrain vehicle and utility terrain vehicle route in the village shall be the snowmobile route described in Schedule Ill of Chapter 74 of this code.
   (D)   Conditions applicable to all-terrain vehicle and utility terrain vehicle routes.
      (1)   Pursuant to Wis. Stats. § 23.33(8)(d), the following restrictions are placed on the use of the village all-terrain vehicle routes designated by this chapter and Chapter 74, Sch. III.
      (2)   Routes shall be marked with uniform all-terrain vehicle route signs in accordance with § NR64.12(7), Wisconsin Administrative Code. No person may do any of the following in regard to signs marking village all-terrain vehicle routes:
         (a)   Intentionally remove, damage, deface, move or obstruct any uniform all-terrain vehicle route or trail sign or standard or intentionally interfere with the effective operation of any uniform all-terrain vehicle route or trail sign or standards if the sign or standard is legally placed by the state, any municipality or any authorized individual.
         (b)   Possess any uniform all-terrain vehicle route or trail sign or standard of type established by the department for the warning instruction or information of the public, unless he or she obtained the uniform all-terrain vehicle route or trail sign or standard in the lawful manner. Possession of a uniform all terrain vehicle route or trail sign or standard creates a rebuttable presumption of illegal possession.
      (3)   A copy of this chapter shall be sent by the Village Clerk to the Iowa County Sheriffs Department and the Department of Natural Resources, PO Box 7921 Madison, WI 53707.
      (4)   In addition to the provisions of Wis. Stats. § 23.33, the following restrictions are placed on the use of the village all-terrain vehicle routes designated by this chapter and Chapter 74, Sch. III:
         (a)   All ATV/UTV operators shall observe a speed limit of ten mph or the posted roadway speed limit, whichever is lower.
         (b)   All ATV/UTV operators shall ride single file.
   (E)   Enforcement. The penalties under Wis. Stat. § 350.11 with respect to snowmobiles and Wis. Stats. § 23.33(13)(a), as the same may be amended from time to time, are adopted by reference. This ordinance may be enforced by any law enforcement officer authorized to enforce the laws of the State of Wisconsin.
   (F)   Severability. If any provision of this chapter or its application to any person or circumstance if held invalid, the invalidity does not affect other provision or application of this chapter that can be given effect without the invalid provision or application, and to this end, the provision of this chapter are severable.
