§ 50.02 SINGLE-FAMILY RESIDENCES, BUSINESS.
   (A)   Pick Up Contracted: Because the Village has entered into a contract with a waste hauling company to provide services to each single-family residence within the Village, no other person, business or corporation shall pick up any garbage, recyclable materials or landscape waste from any single-family residence within the Village. However, yard maintenance services may remove landscape waste from single-family residences.
   (B)   Service Charge: Effective on the next billing cycle for any user commencing on or after April 15, 2015:
      (1)   Service Charge. Pursuant to the contract between the Village and the waste hauling company, each single-family residential customer will be billed a service charge for weekly curbside garbage and recycling material pick up. The Village will add a billing fee to the service charge and will bill each single-family residence be in the amount set forth in the comprehensive fee schedule set forth in Section 12.02 of this code for all services corresponding to the refuse container size. Any senior billing fee (meeting the requirements of division 51.091 (B)(2)(d) of this title) shall be in the amount set forth in the comprehensive fee schedule set forth in Section 12.02 of this code. In addition, pursuant to the contract between the Village and the waste hauling company, each single-family residence will be billed directly by the waste hauler for subscription curbside landscape waste pick up, extra carts, bulk items or white goods.
      (2)   Late Fees. Any customer failing to pay service charges for weekly curbside garbage and recycling material pick up within 21 days of being billed for such charges shall be assessed a penalty, billed on the twenty second day of the month, shall be in the amount set forth in the comprehensive fee schedule set forth in Section 12.02 of this code, it being determined that 10% the fee is a reasonable and proper estimate of the costs incurred by the Village in maintaining records and otherwise administering and enforcing this section. The past due balance and penalty will appear on the next regular bill for services. If the overdue balance and penalty are not paid by the forty fifth day, a subsequent delinquency notice will be sent to the customer and a charge in the amount set forth in the comprehensive fee schedule set forth in Section 12.02 of this code will be added to the customer's bill.
      If, after the second written delinquency notice is sent and the customer’s monthly payment and penalty is still due on the fifty ninth day, the Village may undertake appropriate legal proceedings to enforce collection and the customer shall reimburse the Village for all costs, including court costs, Sheriff fees, attorney fees, and other expenses incurred by the Village for collection of the delinquent charges.
      (3)   Annual Review And Rate Plan Established. Each year, as part of the annual budget process, the Village Board will examine the financial status of the Garbage Enterprise Fund to determine if the rate plan set forth in Section 12.02 of this code should be modified. Unless otherwise modified by the Village Board, the rate plan shall be established in this Section 12.02 of this code.
   (C)   Containers: Each single-family residential customer shall use only those containers or bags specified in the Village’s contract with the waste hauling company for the specific purposes enumerated in the contract.
   (D)   Landscape Waste: No person shall put landscape waste in a container designated for garbage or recyclables. Landscape waste may only be placed in those containers or bags specified for landscape waste in the Village’s contract with the waste hauling company.
