§ 51.091 RATES AND CHARGES ESTABLISHED.
   There are hereby established rates and charges for the use of and for the service supplied by the combined water and sewerage systems of the Village of Lindenhurst, as set forth hereafter, to be effective on all bills issued after May 1, 2017:
   (A)   Water Service Charges:
      (1)   Rate. The bimonthly charge for water service based upon the amount of water consumed, as shown by the water meters, shall be based upon consumption in the amount set forth in the comprehensive fee schedule set forth in Section 12.02 of this code.
      (2)   Separate User. Each residential unit of a multiple dwelling shall be charged and billed as a separate user.
      (3)   Construction Charge. The residential construction water service charge shall be in the amount set forth in the comprehensive fee schedule set forth in Section 12.02 of this code. Each residential unit of a multiple dwelling shall be charged and billed as a separate unit, unless a meter is installed, in which case, the "general water service rates" will apply.
      Any person desiring to use a Village water hydrant for non-residential building or non-Village related construction purposes shall make written application under his or her signature to the Village Administrator, Superintendent of Public Works, or his designee including therein the following:
         (a)   Name, phone number, and business address of applicant;
         (b)   Purpose for request and proposed use;
         (c)   Address of location of hydrant(s) to be used;
         (d)   Date(s) and duration of use;
         (e)   Estimate of gallonage to be used.
      Upon receipt of the application described in this section, the Superintendent of Public Works shall, with reasonable dispatch, review the application and, giving due regard to the nature and quantity of the proposed use, as well as any adverse effects of the proposed use, actual or potential, on the water system of the Village, shall grant or deny the application; provided, however, for any proposed use for which there is a probability that more than 500 gallons shall be taken from the water system, the Superintendent of Public Works may require, as a condition to the permit, that there be utilized at every opening from which water is taken from the Municipal supply, an approved and functioning water meter. The Village shall charge the prevailing water usage rates on all metered temporary services granted in this chapter. Any person hereunder who willfully refuses to install a meter when required or who disconnects, tampers with or attempts in any way to bypass an installed meter is subject to revocation of the permit granted under this chapter in addition to other fines and penalties provided by the general law.
      (4)   Senior Citizen Discount. The total charges shall be reduced by 10% for senior citizens provided that they meet the following requirements on an annual basis:
         (a)   The customer of record, as listed in the Village’s utility billing database, is age 62 or older; and
         (b)   That application is made to the Village prior to July 1, 2020 certifying that the requirement of division (A)(4)(a) of this section is met.
   (B)   Sewer Service Charge:
      (1)   Charge Formula. There shall be and there are hereby established sewer user service charges for the use of and for the wastewater treatment services supplied by the Village pursuant to its written agreement with the Lindenhurst Sanitary District which shall consist of a volume service charge for operation and maintenance plus replacement and a portion for facility/equipment replacement, a customer service charge for costs associated with billing, central administration and other non-volume related costs, a facility/equipment replacement charge for that portion attributable to future plant capacity, and a surcharge if applicable.
      The volume service charge shall be based on the water usage as recorded by approved water meters and/or sewage meters for wastewater having normal concentrations of 204 milligrams per liter of BOD and 250 milligrams per liter of suspended solids.
      The volume service charge shall be determined by the amount of revenue funds required to operate and maintain the sewerage works, to provide funds for the replacement of component parts of said sewerage works, and to provide for a portion for facility/equipment replacement each fiscal year.
      The facility/equipment replacement charge shall be determined as a part of the total amount of revenue funds required for eventual replacement of the facility and equipment.
      The customer service charge shall be determined by the amount of revenue funds required for administrative, billing, and other fund needs that would not be allocated to a volume related parameter.
      (2)   Charges.
         (a)   The bimonthly sewer user charge to be paid by all metered and non-metered sewer users within the Village for each separate dwelling unit and each separate commercial, industrial, institutional user, shall be in the amount set forth in the comprehensive fee schedule set forth in Section 12.02 of this code.
         (b)   Surcharge. A treatment service surcharge shall be levied to all sewer users whose wastewater exceeds the normal concentrations of 204 milligrams per liter of BOD and 250 milligrams per liter of suspended solids as determined by waste sampling which shall be performed as often as deemed necessary by the Village and shall be binding as the basis for computing the surcharge. The surcharge rates shall be in the amount set forth in the comprehensive fee schedule set forth in Section 12.02 of this code.
         (c)   Senior Citizen Discount. The total charges shall be reduced by 10% for senior citizens provided that they meet the following requirements on an annual basis:
            1.   The customer of record, as listed in the Village’s utility billing database, is age 62 or older; and
            2.   That application is made to the Village prior to July 1, 2020 certifying that the requirement of division (B)(2)(d)1 of this section is met.
         (d)   Notification To Customers. Each user will be notified, at least annually, in conjunction with a regular bill, of the rate and that portion of the user charge which are attributable to wastewater treatment services.
   (C)   Annual Review And Rate Plan Established: Each year, as part of the annual budget process, the Village Board will examine the financial status of the Water and Sewer Enterprise Fund to determine if the rate plan set forth in this section should be modified. Unless otherwise modified by the Village Board, the rate plan shall be established in the amount set forth in the comprehensive fee schedule set forth in Section 12.02 of this code and shall increase by an amount of no greater than 3% annually effective for bills beginning with an issuance date of July 1, 2020 and every May 1 thereafter.
   (D)   Capital Utility Fee. In addition to the water service and sewer service charges set forth above in this Section, a capital utility fee shall be imposed on each utility customer in the amount set forth in the comprehensive fee schedule set forth in Section 12.02 of this code. The capital utility fee is not subject to the senior citizen discount. The capital utility fee will be billed on a bi-monthly basis on utility customers' sewer and water bills.
