(A) Definitions: The following words, terms and phrases, when used in this subchapter, shall have the meanings ascribed to them in this division:
Minor. A person under the age of 18 years.
Person. Any individual, corporation, partnership, association or other legal entity.
Tobacco Product. Any item, product or substance containing tobacco leaf, including, but not limited to, cigarettes, cigars, snuff and pipe chewing or dipping tobacco.
(B) Sale By Minors: It shall be unlawful for any minor to sell any tobacco product within the corporate limits of the village.
(C) Sale To Minors: It shall be unlawful for any person to sell any tobacco product to any minor within the corporate limits of the village.
(D) Purchase By Minors: It shall be unlawful for any minor to purchase any tobacco product within the corporate limits of the village.
(E) Possession By Minors: It shall be unlawful for any minor to possess any tobacco product within the corporate limits of the village.
(F) Notice Required: It shall be unlawful for any person to engage in the sale of tobacco products within the corporate limits of the village unless such person prominently displays a current village license and as part of every display of tobacco products offered for sale or upon every vending machine which offers tobacco products for sale, displays the following notice:
THE PURCHASE OF TOBACCO PRODUCTS BY ANY PERSON UNDER THE AGE OF 18 YEARS IS PROHIBITED BY LAW.
Such notice shall be displayed in red letters at least 1 inch in height on a white background.
(G) Responsibility For Agent Or Employee: Every act constituting a violation of this section by an agent or employee of any person shall be deemed and held to be the act of such person, and such person shall be punishable in the same manner as if such act had been done by such person personally.
(H) Exceptions: It shall not be a violation of division (E) of this section if a minor possesses a tobacco product during the course of their employment solely for the purpose of the sale of tobacco products for the benefit of their employer or during a religious ceremony in an established place of worship.
