(A) Whenever the Superintendent of streets of the village determines that because of deterioration, rain, snow, or other climatic conditions, any road or street or portions thereof, within the corporate limits of the village will be seriously damaged or destroyed by the use of certain vehicles thereon he shall file a report of his determination in the Office of the Village Clerk. This report shall first identify by accurate description the roads or streets or portions thereof he finds to be in danger of destruction or damage, and further, the report shall state whether or not said roads or streets or portions thereof are to be closed to vehicular traffic or restricted in use as to type of vehicle or as to weight of vehicle and load. The report shall further state the period of time the restriction shall be in effect, provided however, that no such restriction shall be in effect for a period of time longer than 60 days in any one calendar year.
(B) Within five days after the filing of the report as provided in division (A), the Superintendent of Streets shall cause to be erected and maintained signs at each end of the roads or streets or portions thereof named in his report, which signs shall be so located and in sufficient number to acquaint operators or owners of vehicles using the said roads or streets or portions thereof of the restrictions on use which shall be designated on the signs.
(C) It shall be unlawful for any person to drive or move, or for the owner to cause or knowingly permit to be driven or moved on any road or street or portions thereof, within the corporate limits of the village, any vehicle whose use has been determined to be damaging to the road or streets or portions thereof and whose use is prohibited by the signs so erected and maintained.
(D) Whenever any vehicle is operating in violation of the provisions of this section, the owner or driver, or both, of such vehicle shall be deemed guilty of such violation, and either or both the owner and the driver of such vehicle may be prosecuted for such violation.
