§ 52.212 ENFORCEMENT.
   (A)   Any FOG contributing facility that is not in compliance with the city’s FOG Program and/or Sewer Use Ordinance will be subject to enforcement actions as established in the city’s Pretreatment Enforcement Response Plan (ERP).
   (B)   When an obstruction and/or sanitary sewer overflow occurs, the records of all FSEs or other users that discharge FOG to the affected sanitary sewer line may be reviewed in order to determine the responsible party. Any user found to be in non-compliance with the required grease retention maintenance and service shall be deemed a responsible or contributing party for cost recovery purposes.
   (C)   This policy may be modified or changed by the city at any time in accordance with the requirements of the City Code, North Carolina General Statutes and federal regulations.
   (D)   The fines provided for in this section are not exclusive and do not prohibit the Director from using any other remedy provided by the law. (Any user who is found to have failed to comply with any provision of this policy may be assessed a civil penalty of up to $25,000 per day per violation.)
