(a) A person shall not ignite, discharge or use consumer or display fireworks, except as permitted in this section.
(1) Any person, firm, or corporation violating the provisions of subsections (1), (b), (f), or (g) shall be responsible for a civil infraction and shall be ordered to pay a civil fine of $1,000.00, $500.00 of which will be remitted by the court to the local law enforcement agency responsible for enforcing this section pursuant to Section 7 of MCL 28.457.
(b) Except as prohibited in this subsection, a person is permitted to ignite, discharge or use consumer fireworks, as such term is defined in State Law, on the following days and during the following hours only:
(1) Between 11:00 a.m. on December 31 and until 1:00 a.m. on January 1.
(2) Between 11:00 a.m. and 11:45 p.m. on the Saturday and Sunday immediately preceding Memorial Day.
(3) Between 11:00 a.m. and 11:45 p.m. on June 29, June 30, July 1, July 2, July 3, and July 4.
(4) Between 11:00 a.m. and 11:45 p.m. on July 5, if that day is a Friday or Saturday.
(5) Between 11:00 a.m. and 11:45 p.m. on the Saturday and Sunday immediately preceding Labor Day.
(c) No person shall ignite, discharge, or use fireworks on public property, school property, church property, or the property of another person without that organization's or person's express permission to use those fireworks on those premises. A person who violates this subsection is responsible for a civil infraction and may be ordered to pay a civil fine of not more than $500.00.
(d) A person shall not willfully cause, by way of ignition, discharge, use, or any other means, fireworks to enter upon the lands or premises of another without the express permission of the owner or occupant, or agent or servant of the owner or occupant of the lands or premises. A person who violates this subsection is responsible for a civil infraction and may be ordered to pay a civil fine of not more than $100.00.
(1) A person who pleads or is found responsible for this civil infraction shall be
presumed responsible for any resulting property damage and shall be required to pay full restitution to the property owner.
(e) An individual shall not discharge, ignite or use consumer fireworks or low-impact
fireworks while under the influence of alcoholic liquor, a controlled substance, or a combination of alcoholic liquor and a controlled substance. A person who violates this subsection shall be guilty of a civil infraction and may be ordered to pay a civil fine of not more than $1,000.00.
(1) "Alcoholic Liquor" means that term as defined in Section 1d of the Michigan Vehicle Code, 1949 PA 300, MCL 257.1d.
(2) "Controlled Substance" means that term as defined in Section 8b of the Michigan Vehicle Code, 1949 PA 300, MCL 257.8b.
(f) No minor shall buy or use fireworks, at any time.
(g) No person shall release any unmanned free-floating device (sky lantern) which requires fire underneath to propel it and is not moored to the ground while aloft and has an uncontrolled and unpredictable flight pattern and descent area so as to pose a potential fire risk.
(h) The City Council, upon application in writing, in accordance with the provisions of MCL 28.451 et seq., may grant a permit for the use of fireworks otherwise prohibited by this section for public display by organizations or groups of individuals approved by the City Council.
