(a) Permit Required. No person shall dig or excavate in any manner whatsoever in any alley of the City without first obtaining a permit therefor from the Building Department.

(b) Fees; Terms.
(1) Permits to dig or excavate in the alleys of the City shall be based on the following fees:
A. Mud alleys, with neither stone nor cinder surfacing, five dollars ($5.00);
B. Improved alleys, with either stone or cinder surfacing, fifteen dollars ($15.00); and
C. Paved alleys, one hundred dollars ($100.00) where the pavement break is to be five feet or less in length, and an additional twenty dollars ($20.00) for each foot of length in excess of five.
(2) Applicants for such permits shall inform the Department of Public Works and Public Services of the time when the proposed excavating or digging is to be done.
(3) No private contractor shall break a paved alley. The permit fee provided for in paragraph (b)(1)C. hereof includes the breakage, removal and replacement of the alley pavement, which services shall be performed by the City's personnel.
(4) A condition of each permit to dig or excavate in any alley in the City is that the digger or excavator shall backfill all excavations with sand, shall remove all excess dirt or material and shall restore the alley within which the work was performed as nearly as possible to its condition before the start of the work.

(c) Backfilling. All alleys where excavating or digging takes place shall be backfilled with sand and packed and returned to as near their original surface condition as possible within twenty-four hours after the sewer has been inspected by the City inspector. All excess dirt shall be promptly removed from the alley.
