852.17 COIN-OPERATED MUSIC BOXES.
   (a)   Definitions. As used in this section:
      (1)   "Coin-operated music box" means and includes every music device which is placed into operation by the means of any coin, token, disk, slug or other similar or like device being deposited or inserted therein.
      (2)   "Public place" means and includes any place of business situated in the City where the public in general may enter for the purpose of availing itself of the business conducted therein.

   (b)   License Required. No person shall operate or cause to be operated in any public place in the City any coin-operated music box without first obtaining a license therefor and paying the required license fee.

   (c)   License Application; Investigation.
      (1)   Any person desiring to operate a coin-operated music box shall make application, in writing, to the Mayor and Council for a license therefor, which application shall set forth the name and address of the owner of the music box, the name and address of the owner of the place of business where such music box is to be operated, the name and type of the instrument to be licensed and such additional information as may be required by the Mayor and Council.
      (2)   Upon receipt of such application, the Police Department shall make an investigation and submit the results of such investigation to the Mayor and Council.

   (d)   License Issuance; Fee. Upon receipt of the report of such investigation, if it appears that the applicant is operating and conducting a proper and legitimate business and is a person of good moral character, the Mayor and Council shall issue a license, which license shall be issued by the City Clerk upon payment of a license fee of ten dollars ($10.00) (Adopting Ordinance)
   (e)   License Expiration; Renewals. All licenses and renewals thereof shall expire on the first Tuesday of May next succeeding the issuance thereof. Renewals may be made in a like manner and upon payment of a like license fee, as required for the original license.

   (f)   License Suspension or Revocation. The Mayor and Council may suspend or revoke any such license upon complaint having been made and evidence furnished that the licensee is conducting a place of business which is immoral or illegal, or which constitutes a menace to the public welfare.

   (g)   Hours of Operation. All coin-operated music boxes shall be operated in such a manner so as not to cause any undue noise or disturbance and shall not be operated between 2:00 a.m. and 8:00 a.m., except upon special permission granted by the Mayor and Council.

   (h)   Responsibility for Disturbances. Any licensee operating a coin-operated music box shall be responsible for any disturbance caused by the patrons upon the premises where such music box is operated. If it appears that undue disturbance is being caused by the operation of such music box, the licensee shall disconnect and cease the operation of such music box.
