(a) Defined. As used in this section, "spray can" means any can, container or portable device consisting of paints, pigments, solvents, dressings, sealers or cements packaged or prepared and stored therein under pressure of compressed air, freon or any other gas of the type commonly used in the manufacture and production of portable paint spray devices.

(b) Violations. No person shall, for the purpose of violating or aiding another to violate any of the provisions of this section, intentionally possess, buy, sell, transfer or receive possession of any spray can.

(c) Possession by Minors Prohibited; Exception.
(1) Except as provided in paragraph (c)(3) hereof, no person under eighteen years of age shall possess or buy any spray can.
(2) No person shall sell or transfer possession of any spray can to another person under eighteen years of age. However, a person may sell or transfer possession of a spray can to a person under eighteen years of age for painting or other lawful use where the juvenile has in his or her possession and exhibits the written consent of his or her parent or guardian.
(3) This section shall not apply to the possession and use of a spray can in the private residence dwelling of any person or upon the curtilage thereof.

(d) Records of Sales. A person making a sale or transfer of possession of a spray can to a person under eighteen years of age who exhibits the written consent of his or her parent or guardian shall record the name, address, sex and age of the juvenile and the name and address of the consenting parent or guardian. All data required by this section shall be kept in a permanent register available for inspection by the Police Department for at least six months.

(e) Aiding or Abetting Minors. No person shall assist, aid, abet or encourage any minor to violate this section.
