294.05 ELIGIBILITY FOR MEMBERSHIP.
   (a)   The membership of the retirement system shall include:
      (1)   All appointed officers and employees of the City who were in the employ of the City on the day preceding the effective date of the retirement system and who continue in the employ of the City on and after the effective date of the retirement system; and
      (2)   All appointed and elected officers and employees of the City and those employees of the 25th District Court who are not covered by the State retirement system who become employed by the City on and after the effective date of the retirement system.
   (b)   The membership of the retirement system shall not include:
      (1)   Any person whose pay, in a period of three consecutive service years, averages less than four thousand dollars ($4,000) a year;
      (2)   Any person whose services are compensated for on a contractual or fee basis;
      (3)   The medical director;
      (4)   Police officers and firefighters who come under the Policemen's and Firemen's Retirement System provided for in Chapter 296; or
      (5)   Any person classified as a temporary, seasonal, part-time or casual employee.
   (c)   In cases of doubt, the Retirement Commission shall decide who is a member of the retirement system within the meaning of this chapter.
