248.01 WATER DISTRIBUTION SYSTEM OPERATOR.
   (a)   Establishment of Office. The office of Water Distribution System Operator is hereby established in and for the City pursuant to Chapter IV of the City Charter.
   (b)   Appointment; Term of Office. The Water Distribution System Operator shall be appointed by Council and shall hold office as such for a term to expire on the first Monday in January of eodd numbered years.
   (c)   Qualifications. The Water Distribution System Operator shall hold a valid and current S-1 certification from the State and shall maintain such certification as a condition of appointment.
   (d)   Powers and Duties. The Water Distribution System Operator shall be in charge of the City's water distribution system or waterworks system, as defined in Act 399 of the Public Acts of 1976, as amended (M.C.L.A. 325.1001 et seq.). The operator shall also:
      (1)   Abide by and carry out rules and regulations promulgated by the State Department of Public Health, which rules and regulations relate to water distribution and which are applicable to the classification designated for the City by the Department;
      (2)   Abide by and perform all applicable duties as required under Act 399 of the Public Acts of 1976, known as the Safe Drinking Water Act;
      (3)   Observe and comply with all Federal and State laws and local ordinances which relate to the Operator's duties in supervising the City's public water supply system distribution of water for drinking or household purposes according to standards established by the Department;
      (4)   Submit such reports and maintain such records as may be required by State law, the Department and the Mayor; and
      (5)   Report to the Mayor and Council any problems which may affect the City's water supply, and make recommendations as to corrective action deemed necessary to protect drinking water standards.

   (e)   Compensation and Benefits. The salary of the Water Distribution System Operator shall be as determined from time to time by Council, and he or she shall receive no fringe benefits or overtime. Such salary shall be paid in equal payments on the regular paydays established for classified employees of the City.
