(A) AFSCME Parity Employees are hereby defined to be those City employees and officials who are not members of an employee organization recognized by the City for the purposes of collective bargaining or otherwise certified by the State Employees Relations Board for collective bargaining.
(1) This section does not apply to employees of the municipal court judges or employees of the municipal court clerk, unless the wages of such employees are determined by council under state law.
(2) This section does not apply to non-union employees who are members of the Lima Police Department or the Lima Fire Department; except this section does apply to the positions of Secretary to the Police Chief and Secretary to the Fire Chief.
(B) AFSCME Parity Employees shall be paid according to the biweekly pay ranges and pay schedules established under the collective bargaining agreement (CBA) with the American Federation of State, County and Municipal Employees, Ohio Council 8, Local 1002, AFL-CIO (AFSCME), as such CBA may then be in effect over time. AFSCME Parity Employees paid according to pay ranges 26 through 35 shall receive the same percentage increases as provided to the lower pay ranges, and the Auditor is authorized to amended the pay schedules for pay ranges 26-35 by the same percentages accordingly. Such ranges shall be applied to the several classes or positions for AFSCME Parity Employees established by Council or unless otherwise specified by Council.
(1) This subsection does not apply to City employees, administrators, or officials whose pay is established by other separate ordinance.
(C) In addition to the basic pay plans in (B) above, the AFSCME Parity Employees are entitled to receive those same economic benefits as are set forth in the AFSCME CBA, as may then be effective. This shall include but is not limited to lump sum payments or bonuses, health care benefits, overtime pay rate, holidays, personal days, vacations, sick leave, funeral leave, jury duty, longevity pay, and shall specifically exclude all non-economic benefits including but not limited to the provisions referring to work time, discipline, discharge and benefits specifically related to union representation. The City Auditor shall make the final determination of what constitutes an economic or non-economic benefit, unless otherwise determined by Council.
(1) Any provision in the AFSCME CBA regarding a lump sum payment or bonus shall not apply to City employees, administrators, or officials whose pay is established by other separate ordinance.
