244.03   SICK LEAVE; RETIRE/REHIRE EMPLOYEES.
   (A)   Employees shall be entitled to sick leave and vacation leave benefits, including payment for accumulated sick leave and vacation leave, in accordance with any applicable collective bargaining provision or other Ordinance or provision of this Chapter.
   (B)   Any employee who has retired or resigned from City employment and who has subsequently been rehired (a retire/rehire employee), shall not be entitled to carry forward any unused sick leave balance or vacation leave balance which accumulated during the prior employment period.
      (1)   Any such retire/rehire employee shall not be entitled to any payment or payout for sick leave or vacation leave which accumulated during the time of the rehired employment.
      (2)   The first paragraph of this subsection (B) shall not apply to retire/rehire employees who were rehired prior to the date of passage of Ordinance 143-14 (June 9, 2014); however, subsection (B)(1) above which prevents a second sick leave and vacation leave payout shall be applicable to such employees.
   (C)   The provisions of this section shall supercede any conflicting provisions regarding sick leave that may be contained in any other section of this Chapter which was enacted prior to the date of passage of Ordinance 143-14 (June 9, 2014).
