§ 51.116 STORM WATER RATES.
   (A)   Definitions. For the purpose of this section the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      EQUIVALENT RESIDENTIAL UNIT (ERU). The amount of impervious area included upon an average residential property. An impervious area refers to those surface areas of residential and non-residential properties which water will not penetrate and from which storm water runoff will be produced.
      LARGE INDUSTRIAL. All properties not encompassed within the definition of residential, non-residential class I, and non-residential class II, that are assigned 500,000 or greater square feet of impervious area.
      NON-RESIDENTIAL CLASS I. All properties not encompassed within the definition of residential property, including but not limited to: multi-family, commercial, industrial, governmental, educational and churches that are assigned zero to 124,999 square feet of impervious area.
      NON-RESIDENTIAL CLASS II. All properties not encompassed within the definition of residential and non-residential class I property, including but not limited to: multi-family, commercial, industrial, governmental, educational and churches that are assigned 125,000 to 499,999 square feet of impervious area.
      RESIDENTIAL shall mean any lot or parcel existing in the city on which a single building or mobile home is situated; containing up to and including four dwelling units on a single water meter.
   (B)   Monthly fee. The initial monthly fee is to be paid by each user and shall be paid according to the following schedule effective July 1, 2013.

   (C)   Creation of Storm Water Revenue Fund. Rates and charges incurred under this section shall be prepared and collected by the city in accordance with those provisions regulating the preparation and issuance of bills for sewer service generally. The monies collected under this section shall be deposited in the Storm Water Revenue Fund hereby created.
   (D)   All rates and charges not paid by the fifteenth day following the billing date are hereby declared to be delinquent and a penalty of 10% of the amount of the rates or charges outstanding shall be charged and shall become a part of the bill.
   (E)   Notwithstanding division (D), for utility payments due on April 15, 2020, the city shall not collect any delinquency penalty.
