§ 99.10 PROPERTY OWNER OR OCCUPANT’S RIGHTS TO OBJECT TO NOTICE TO ABATE.
   (A)   Upon receipt of a notice to abate, the property owner or occupant served, or his or her duly authorized representative, may notify the Code Enforcement Officer of an intent to object to any notice to abate, or any portion thereof. This correspondence shall be in writing, and shall specify the street address and legal description of the property involved. Any such correspondence must be received by the Code Enforcement Officer within five days after the notice to abate is given as provided herein.
   (B)   Upon receipt of such correspondence objecting to the notice to abate, the Code Enforcement Officer shall provide copies of the same to the Mayor, who shall appoint a hearing officer therefor. The hearing officer shall conduct a hearing on the objection within ten days of his or her appointment.
   (C)   No further action shall be pursued against that owner to abate the environmental public nuisance unless the objection to the notice to abate is overruled by the hearing officer.
