(A) Any dog or cat found running at large upon the streets, alleys, commons, lots or lands in the city, shall be captured and restrained by persons acting under the direction of the Common Council or the Board of Public Works and Safety.
(B) The dogs or cats shall be held for a period of at least ten days, after which time the dogs or cats shall be destroyed, sold or given to the Humane Society of Noble County. However, the owner or any other responsible person may, within the ten-day period or until the animal is destroyed, sold or given to the Humane Society of Noble County, reclaim the dog or cat by the payment of a $50 capture fee, plus $10 per day for boarding expenses.
