(A) (1) The following areas in Kenney Park will be closed to the public from October 1 to April 30:
(a) Softball/basement diamonds;
(b) Restrooms;
(c) Parking lots;
(d) The playground will be open from daylight to dark year round.
(2) The track located at Kenney Park will be open 24 hours a day.
(3) Woodlawn Park shall be open from daylight to dusk. This provision shall not be applicable to individuals or groups renting Woodlawn Cabin.
(4) Madden Park shall be open from daylight to dark.
(5) All other parks shall be open from daylight to dark.
(B) No shoes with cleats are permitted in Kenney Park except on baseball diamonds.
(C) Parking on the grass is not allowed in any park, except as designated by signage.
(D) No vendors are permitted to operate within the parks without a permit from the Ligonier Park Department and City and County Health Departments.
(E) Smoking is prohibited where designated by signage.
(F) No posters are permitted on park property.
(G) It shall be unlawful for any person to toss, drop, throw away, deposit or otherwise discard ashes, coals, used matches or smoking materials upon grounds, in water, or in trash containers located within a city park.
(H) It shall be unlawful for any person to kill, wound, hunt, trap, shoot, throw rocks or missiles at, chase, molest or remove any feral mammal, reptile, amphibian or bird, or the young of any such mammal, or the eggs or young of any such reptile, amphibian or bird, within a city park, or to knowingly buy, receive, have in his or her possession, sell or give away any such mammal, reptile, amphibian, bird or egg so killed or taken within any city park.
(I) The improper use of refuse disposal receptacles and excavating are prohibited. Except as hereinafter provided, it shall be unlawful for any person to bring refuse (as that term is defined by I.C. 35-45-3-2(b)) into any park and to deposit the refuse within the park in a park refuse disposal receptacle.
(J) It shall be unlawful for any person within any park to:
(1) Disobey an order of, or interfere with the duty of a Ligonier Parks Employee, credentialed Park Board Member, or City Police Officer.
(2) Disobey or disregard the notices, prohibitions, instructions or directions posted on any park sign. This includes, but is not limited to, the rules and regulations for shelters, pavilions, playground areas, recreation centers or facilities.
(3) Solicit alms, subscriptions or contributions without the prior written permission of the Park Board.
(4) Distribute any materials advertising or promoting any commercial product without the prior written permission of the Park Board.
(5) Photograph any portion of park property for promotion or sale of any commercial product, or commercial event, without the written permission of the Park Board.
(6) Pitch or maintain a tent or other improvised shelter for the purpose of overnight camping without a permit issued by the Director of the Ligonier Parks Department.
(K) Vehicle use restrictions:
(1) The maximum speed of any vehicle operated within a park boundary is limited to ten miles per hour. It shall be unlawful for any person to operate a vehicle in excess of this speed limit.
(2) No person shall cause or permit any vehicle under his or her control to obstruct traffic or access to gates.
(3) No person shall operate a vehicle within any park area except upon roadways or other areas specifically designated for vehicle traffic.
(4) No motorized vehicles are allowed on the track located at Kenney Park.
(5) No person shall cause a vehicle to enter or leave any park area except at established entrances or exits.
(6) No person shall park a vehicle in any park area not designated for designed for parking.
(L) The following are limitations on access and use of park areas/facilities:
(1) Any use of any park area or facility outside the posted access hours is prohibited without a written permit issued by the Director of the Ligonier Parks Department.
(2) No vehicle shall be operated or left in a park area outside the posted access hours without a written permit issued by the Director of the Ligonier Parks Department. Any vehicle left on park premises after hours without such authorization may be towed from the park without further notice to the owner or operator. The registered owner will be responsible for any towing and storage fees.
(3) No person shall use or occupy any park shelter or facility while posted as reserved for some specific organized function or group of persons unless such has been authorized to do so by the responsible person designated in the written reservation agreement.
(M) The following are the limitations on animals. No domestic animals, other than service animals (as the same are defined in I.C. 35-46-3-11.5), are allowed in athletic, youth activity areas, or baseball and/or softball diamonds, designated by signage.
(N) Scheduling. All public and organizational events must be scheduled through the Ligonier Parks Department.
(O) No skateboards and rollerblades shall be permitted in picnic areas or upon paved or finished basketball courts or tennis courts.
(P) (1) Any violations of the provisions of this section shall be punishable by a fine of not less than $200 and not more than $2,000. Each day a violation occurs shall constitute a separate violation of this section.
(2) The violator may admit the violation at the Ligonier Ordinance Violation Bureau and pay the following fines:
(a) Five dollars for the first violation;
(b) Twenty dollars for the second violation within a calendar year; and
(c) Fifty dollars for a third violation within a calendar year.
