If any waters or wastes are discharged, or are proposed to be discharged, to the public sewers, which waters contain the substances or possess the characteristics enumerated in § 51.035 above, and which in the judgment of the Superintendent may have a deleterious effect upon the sewage works, processes, equipment or receiving waters, or otherwise create a hazard to life or constitute a public nuisance, the Superintendent may:
(A) Require the user or discharger to submit information on wastewater characteristics and obtain prior approval for discharges;
(B) Reject the wastes in whole or in part for any reason deemed appropriate by the Superintendent;
(C) Require pretreatment of the wastes to within the limits of normal domestic sewage as defined;
(D) Require control of flow equalization of the wastes so as to avoid any "slug" loads or excessive loads that may be harmful to the treatment works;
(E) Require that any new construction tributary to the combined sewers be designed to minimize or delay inflow contribution to the existing combined sewer; and
(F) Require payment of a surcharge on any excessive flows or loadings discharged to the treatment works to cover the additional costs of having capacity for and treating the wastes. If the Superintendent permits the pretreatment or equalization of waste flows, the design and installation of the plant and equipment shall be subject to the review and approval of the Superintendent and subject to the requirements of all applicable codes, ordinances and laws. Any surcharge required to be paid by the Superintendent shall be subject to the approval of the Board.
