§ 90.02 KEEPING CERTAIN ANIMALS PROHIBITED.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      PERSON. Any human being, firm, partnership, corporation or other legally recognizable entity.
      PROHIBITED ANIMAL. Farm animals like, but not limited to, cows, pigs, sheep, goats, horses, chickens, and guineas, and provided further that the term shall include any animals kept solely or partially for commercial purposes.
   (B)   (1)   From and after the effective dates of the section, no person shall keep or maintain any prohibited animal on any premises or real estate occupied, controlled or possessed by the person within the town.
      (2)   From and after the effective dates of this section, no person shall keep or maintain any prohibited animal on any public premises or public real estate or an any premises or real estate owned, possessed or controlled by any other person within the town.
      (3)   From and after the effective date of this section, no person shall knowingly permit any prohibited animal to be kept, maintained or remain on any premises or real estate owned, controlled or possessed by the person within the town.
   (C)   In the event that the violation of any part of this section is found to exist, the Town Marshal or any deputy marshal shall have the right to impound any offending animal and dispose of it in any humane manner, provided any reasonable steps are taken to notify the offending person and no remedial action is taken thereby.
