§ 53.11 HAULED WASTEWATER.
   (A)   (1)   Septic tank waste may be introduced into the POTW only at locations designated by the POTW Director, and at times as are established by the POTW Director.
      (2)   The waste shall not violate § 53.03 through this section or any other requirements established by the town. The POTW Director may require septic tank waste haulers to obtain wastewater discharge permits.
   (B)   (1)   The POTW Director shall require haulers of industrial waste to obtain wastewater discharge permits.
      (2)   The POTW Director may require generators of hauled industrial waste to obtain wastewater discharge permits.
      (3)   The POTW Director also may prohibit the disposal of hauled industrial waste. The discharge of hauled industrial waste is subject to all other requirements of this chapter.
   (C)   (1)   Industrial waste haulers may discharge loads only at locations designated by the POTW Director. No load may be discharged without prior consent of the POTW Director.
      (2)   The POTW Director may collect samples of each hauled load to ensure compliance with applicable standards.
      (3)   The POTW Director may require the industrial waste hauler to provide a waste analysis of any load prior to discharge.
   (D)   (1)   Industrial waste haulers must provide a waste-tracking form for every load. This form shall include, at a minimum, the name and address of the industrial waste hauler, permit number, truck identification, names and addresses of sources of waste and volume and characteristics of waste.
      (2)   The form shall identify the type of industry, known or suspected waste constituents, and whether any wastes are RCRA hazardous wastes.

FEES; WASTEWATER DISCHARGE PERMIT APPLICATION; REPORTING REQUIREMENTS
§ 53.25 PURPOSE.
   (A)   It is the purpose of this chapter to provide for the recovery of costs from users of the wastewater disposal system of the town for the implementation of the program established herein.
   (B)   The applicable charges or fees shall be set forth in a schedule of sewer use charges and fees by the POTW Director and approved by the Town Council. A copy of these charges and fees will be made available from the POTW Director.

§ 53.26 USER CHARGES.
   A user charge shall be levied on all users including, but not limited to, persons, firms, corporations or governmental entities that discharge, cause or permit the discharge of sewage into the POTW.
   (A)   The user charge shall reflect, at least, the cost of debt service, operation and maintenance (including replacement) of the POTW.
   (B)   Each user shall pay its proportionate cost based on volume of flow.
   (C)   The Manager of the town shall review annually the sewage contributions of users, the total costs of debt service, operation and maintenance of the POTW and will make recommendations to the Council or Board serving the town for adjustments in the schedule of charges and fees as necessary.
   (D)   Charges for flow to the POTW not directly attributable to the users shall be distributed among all users of the POTW based upon the volume of flow of the users.

§ 53.27 SURCHARGES.
   The amount of the surcharges will be based upon the volume of flow and the character and concentration of the constituents of the wastewater.
   (A)   The volume of flow used in determining the total discharge of wastewater for payment of user charges and surcharges shall be based on the following:
      (1)   Metered water consumption as shown in the records of meter readings maintained by the town;
      (2)   If required by the town or at the individual dischargers option, other flow monitoring devices which measure the actual volume of wastewater discharged to the sewer. The devices shall be accessible and safely located, and the measuring system shall be installed in accordance with plans approved by the town. The metering system shall be installed and maintained at the users expense according to arrangements that may be made with the town; and
      (3)   Where any user procures all or part of his or her water supply from sources other than the town, the user shall install and maintain at his or her own expense a flow measuring device of a type approved by the town.
   (B)   The character and concentration of the constituents of the wastewater used in determining surcharges shall be determined by samples collected and analyzed by the town. Samples shall be collected in a manner so as to be representative of the actual discharge and shall be analyzed using procedures set forth in 40 C.F.R. Part 136.
   (C)   The determination of the character and concentration of the constituents of the wastewater discharge by the POTW Director or his or her duly appointed representatives shall be binding as a basis for charges.

§ 53.28 PRETREATMENT PROGRAM ADMINISTRATION CHARGES.
   The schedule of charges and fees adopted by the town may include charges and fees for:
   (A)   Reimbursement of costs of setting up and operating the pretreatment program;
   (B)   Monitoring, inspections and surveillance procedures;
   (C)   Reviewing slug control plans, including accidental and/or slug load discharge procedures and construction plans and specifications;
   (D)   Permitting; and
   (E)   Other fees as the town may deem necessary to carry out the requirements of the pretreatment program.

§ 53.29 WASTEWATER DISCHARGERS.
   (A)   It shall be unlawful for any person to connect or discharge to the POTW without first obtaining the permission of the town.
   (B)   When requested by the POTW Director, a user must submit information on the nature and characteristics of its wastewater within 30 days of the request.
   (C)   The POTW Director is authorized to prepare a form for this purpose and may periodically require users to update this information.
