3-4-8: REFUSE:
   A.   Collection: Owners of property in the District shall provide for collection, removal and disposal of refuse generated on their premises at least once a week. Refuse shall be placed in containers as described in this section and set out for collection as set forth in subsection 3-4-4E of this chapter.
      1.   Residents shall be allowed to place up to two (2) cubic yards of household construction and demolition debris generated by "do-it-yourself" projects as part of regular refuse set-outs. Larger quantities of household construction and demolition debris shall require special pick-up service pursuant to subsection G of this section.
   B.   Containers:
      1.   Customers/Covered Units (One And Two-Family Residences): All refuse to be collected in the regular weekly customer service shall be placed in approved containers except for such items as are too bulky to fit in said containers. An approved container for customers shall mean a roll-out cart or a container of standard waterproof construction and made of durable, rigid, heavy duty plastic, aluminum, galvanized steel or other acceptable metal with a tight-fitting cover and with handles suitable for lifting by one (1) person. Except as hereinafter provided, such containers shall have a capacity of not less than ten (10) gallons nor more than thirty-two (32) gallons, and not weigh more than fifty (50) pounds when filled. Subject to the provisions of subsection G, there shall no limit to the number of approved refuse containers customers may place for curbside pick-up by the waste hauler under contract with the Town.
         a.   Each Customer/Covered Unit shall be provided with one (1) Roll-Out Cart for Refuse and one (1) Roll-Out Cart for Recyclables. If the Customer requests additional Refuse and/or Recycling carts, the price shall be as follows:
            (1)   One additional cart - $5.00 per month.
            (2)   Two or more additional carts - $30.00 per month.
            The charge for additional carts shall appear on the Customer’s monthly Sewer/Water and Garbage bill.
         b.   Each customer shall be responsible for the reasonable care of its refuse containers. Containers must be kept closed with lids or covers at all times, as not to allow debris to escape or harbor mosquitoes, flies, rodents, vermin or other disease carrying animals that create a nuisance, results in noxious or offensive smells, or that is otherwise offensive or dangerous to the public health.
      2.   Nonresidential Customers (Multi-Family and Commercial): Where fully enclosed metal container systems exceeding thirty-two (32) gallons in capacity are now in use at multi-family dwellings or commercial buildings, or where the property owners request such systems or the waste hauler under contract with the Town deems such system with respect to any multi-family dwellings or commercial buildings where such containers are not in use, then fully enclosed metal containers in excess of thirty-two (32) gallons in capacity shall be provided by the waste hauler, or may be utilized by such customer if approved by the waste hauler. With respect to such containers, the minimum bottom width shall be no less than thirty-one (31) inches for one (1) cubic yard of container space and the container shall be provided with outriggers.
         a.   Larger size containers shall be proportionately wider at the bottom.
         b.   Containers having a capacity of four (4) cubic yards or more shall be no higher than forty-three inches (43") with a four (4) piece lid opening.
         c.   Containers shall meet federal and state safety standards.
      3.   Whenever containers in excess of thirty-two (32) gallon capacity are used for multi-family or commercial buildings, the waste hauler under contract with the Town shall furnish regularly scheduled collection service twice weekly unless a compactor is provided by the property owner.
      4.   Containers, in excess of thirty-two (32) gallon capacity, used for providing service to multi-family and commercial buildings shall be cleaned by the waste hauler under contract with the Town at least quarterly or more often if necessary, to keep them in sanitary condition. Any cleaning required more frequently than once each quarter, as deemed necessary by the Town shall be at the expense of the customer served.
      5.   Non-Customers: Each owner of a multi-family dwelling or a commercial building in the District not serviced by the waste hauler under contract with the Town, shall provide refuse containers specified in subsection B2 or a waterproof dumpster with a close fitting lid for the collection and disposal of refuse generated on the premises by the owner, tenants and occupants. All refuse generated from such buildings shall be collected and disposed of in such containers. Containers must be kept closed with lids or covers at all times as to not allow debris to escape or harbor mosquitoes, flies, insects, rodents, vermin or other disease carrying animals, that create a nuisance, results in noxious or offensive smells, or that is otherwise offensive or dangerous to the public health.
      6.   Disposal In Bags: All refuse to be disposed of pursuant to this section shall first be placed in bags complying with subsection C below.
   C.   Refuse Bags: All refuse shall be disposed of in a closed or sealed bag, except for large single items of refuse which do not fit in a standard garbage bag but which fit in the containers described in subsection B of this section. Refuse bags shall then be placed in containers described in said subsection B of this section.
   D.   Availability Of Landfills Or Incinerators: All refuse haulers engaged in waste collection and disposal in the district shall have available to them at all relevant times one or more landfill sites or incinerators with all necessary or appropriate federal, state, and local permits, licenses or approvals for the operation of the disposal facility.
   E.   Waste Not Subject To Collection: Nonmunicipal waste, hazardous waste, special waste, toxic waste, solid waste resulting from industrial or manufacturing process, waste produced or generated as the result of construction or repair activity (unless such construction or repair waste is placed in a container that meets the requirements of subsections B and C of this section), white goods, furniture and other similar items shall only be disposed of by waste haulers and in disposal facilities having all necessary or appropriate federal, state and local permits, licenses and approvals.
   F.   Cleanup Days: From time to time the town may designate a day or days for the collection of large items from residential customers which are otherwise not subject to collection. Subject to the town supervisor's regulations and the requirement of subsection 3-4-4E of this chapter, miscellaneous waste items such as those described in subsection E of this section may be placed out for collection on a public right of way, adjacent to the owner's premises, on the cleanup day or days designated by the town for collection and disposal.
   G.   Special Pick-Ups:
      1.   Customers/Covered Units:
         a.   Household Construction And Demolition Debris: The waste hauler under contract with the Town, shall offer customers special pick-up services for the collection of household construction and demolition debris in approved containers when the quantity of such materials exceeds two (2) cubic yards, or for large quantities of waste arising from residential move-ins or move-outs. Special pick-up services shall be made available at least one time each week at rates established in the contract between the Town and the waste hauler.
            (1)   The waste hauler shall provide the customer with an estimate of the cost of a special pick-up service within forty eight (48) hours after receiving a special pick-up request. The cost of such service shall be billed to the customer by the waste hauler.
            (2)   Special pick-ups shall be accomplished within one (1) week after requested by the customer.
         b.   Electronic Waste: The waste hauler under contract with the Town shall provide for electronic waste and recycling if the customer calls ahead to request the service. Electronic waste collection service shall be provided on the same day as regular waste collection and at no additional cost to the customer or Town. The waste hauler shall also provide gaylord boxes to the Town for the purpose of collecting electronic waste at the Township Highway Garage. The waste hauler shall remove and recycle all electronic waste collected through the drop-off program at no additional cost to the Town.
         c.   Household Hazardous Waste: The waste hauler under contract with the Town shall provide household hazardous waste collection and disposal if the customer calls ahead to request the service. Household hazardous waste collection shall be provided on the same day as regular waste collection at no additional cost to the customer or Town.
         d.   White Goods/Bulk Items: Customers shall notify the waste hauler under contract with the Town twenty-four (24) hours in advance for the collection of White Goods or any bulk item weighing more than fifty (50) pounds.
      2.   Non-Customers: Special pick-up collections of miscellaneous waste items otherwise not subject to collection may be arranged by non-customers with a licensed waste hauler. All special pick-ups will take place at such times during normal business hours and days as may be mutually convenient for both the non-customer and the waste hauler, subject to restrictions of subsection 3-3-4E of this chapter, provided such pick-up does not interfere with the normal collection and disposal of waste under this chapter.
