PUBLIC HEALTH, SAFETY AND PROTECTION

GENERAL HEALTH, SAFETY AND PROTECTION PROVISIONS

3-1-1: Special Police District
3-1-2: Garbage, Junk and Abandoned Vehicle Deposits
3-1-1: SPECIAL POLICE DISTRICT:
   The unincorporated area of Leyden Township is hereby declared a special police district for tax purposes, in accordance with the statute in such case made and provided. 1 (Res., 10-21-69)
3-1-2: GARBAGE, JUNK AND ABANDONED VEHICLE DEPOSITS:
   A.   Purpose: A serious problem deleterious to the health, welfare and safety of the citizens of the Town of Leyden exists by reason of the actions of certain residents in disposing of garbage, abandoning vehicles, junk and other wastes by depositing them or causing them to be deposited on the public ways and property of the Township. Such dumping and abandonment also hampers and prevents the Town of Leyden, its various agencies, departments and the Highway Commissioner from their respective statutory duties.
   The Legislature of the State of Illinois has enacted legislation to prevent and remedy such situation, and the Town Board of Trustees has determined it to be a vital interest of the Township to prevent such dumping and abandonment. Therefore, the Town Board of Trustees and the Highway Commissioner have taken immediate steps and act to remedy this situation.
   B.   Enforcement: The Highway Commissioner, Town Supervisor and Town Attorneys are hereby authorized to prosecute either criminally or civilly or both, violators of this Section and to make complaint through lawful authority against said violators for prosecution according to law.
   C.   Nonliability of Enforcing Officers: The Highway Commissioner, Town Supervisor and Town Attorneys shall not be held to answer or be liable for damages in any action brought by any person allegedly aggrieved by their action under this Section or brought similarly by any other person, and if they, or any of them, are so held liable that they be reimbursed, indemnified and held harmless by the Corporate Fund, save for the Highway Commissioner, who shall be similarly held harmless by the Road and Bridge Fund.    D.   Penalties: Any person who shall violate any of the provisions of this Chapter shall be fined not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00) for each offense and every day on which such violation continues shall constitute a separate and distinct offense.
