3-4-6: LANDSCAPE WASTE:
   A.   Mandatory Separation; Disposal: No person shall combine landscape waste with any other household waste for the purposes of disposal or collection. No person shall set landscape waste out for collection in any container other than the landscape waste containers described in subsection E of this section.
   B.   All landscape waste haulers shall dispose all landscape waste at a lawfully operated and duly licensed and/or permitted disposal facility, unless otherwise directed by the Town pursuant to an agreement or license conditions to dispose of landscape waste in a particular site or location. A facility may treat, compost, grind, or land apply said landscape waste. No landscape waste may be disposed of at a landfill or solid waste incinerator unless otherwise authorized by the Illinois Environmental Agency (IEPA).
   C.   Composting: No person shall compost landscape waste in the District without a permit therefor unless the waste was generated on the property on which it is to be composted. The Town encourages and permits mulching and/or composting of landscape waste on the property on which it was generated provided that such mulching or composting is performed so as not to create a nuisance.
   D.   Open Burning: No person shall burn any accumulations of landscape waste on any private or public property.
   E.   Landscape Waste Containers:
      1.   Landscape waste shall be placed into bags, which shall be flat bottom thirty (30) gallon paper bags of a minimum two (2) ply, fifty (50) pound wet strength Kraft paper, with approximate dimensions of sixteen inches by twelve inches by thirty five inches (16" x 12" x 35"), or other biodegradable paper bags of comparable size and quality. Plastic bags, whether described as "biodegradable" or not, shall not be permitted except by prior written agreement between the waste hauler and the Town.
      2.   Landscape waste generated on the premises of customers/covered units for collection by the licensed waste hauler under contract with the Town may also be placed in an approved thirty-two (32) gallon container that is clearly marked with a sixteen inch (16") red painted "X" on both sides. This container shall not weigh more than fifty (50) pounds when full.
   F.   Landscape Brush, Branches And Shrubbery: Loose brush, branches and shrubbery cuttings (four inches (4") or less in diameter), if securely tied in bundles not exceeding four feet (4') in length and sixty (60) pounds in weight, shall be collected by the waste hauler if the bundle is properly placed at the curbside for pick-up.
   G.   Costs: The cost of curbside collection and disposal of landscape waste, including landscape brush, branches and shrubbery as described in subsection F above, from customers/covered units, will be charged to the customers/covered units by the waste hauler under contract with the Town as part of the municipal solid waste collection, removal and disposal services.
   H.   Quantity Subject To Weekly Collection: There shall be no limit as to the number of landscape waste containers or properly bundled brush, branches and shrubbery which may be deposited by customers/covered units for pick-up by the waste hauler under contract with the Town.
   I.   Enclosed Storage Of Landscape Waste: No person shall store, place or deposit any landscape waste, except firewood, within an enclosed structure. All firewood stored within an enclosed structure must be stored in a place and manner so that it is not susceptible to spontaneous combustion.
   J.   Blowing Or Drifting Waste: All persons shall exercise due care to prevent accumulations of landscape waste from blowing or drifting onto the property of another.
   K.   Prohibition On Use Of Landscape Waste Collection Service And Containers:
      1.   No person shall mix landscape waste with other waste materials in any landscape waste collection containers. No landscape waste containers shall be placed for pickup if they contain nonlandscape waste materials.
      2.   No person shall place any landscape waste for collection by the licensed waste hauler under contract with the Town if such waste was not generated on the premises of the residential customer placing such waste for collection at the curbside of the person’s property.
      3.   No residential customer shall suffer or permit any other person to place landscape waste not generated on the customer’s premises in landscape waste containers placed for collection from customer’s premises.
      4.   All landscape, lawn or yard services shall contract separately for removal and/or disposal of landscape waste generated within or without the District. No person may place any landscape waste collected through such services for regular collection from the premises of residential customers by the licensed waste hauler under contract with the Town.
      5.   No landscape, lawn or yard service may deposit landscape waste in any centralized landscape waste drop-off container as may be provided by the Town. (Ord. TO-92-1, 1-14-1992; amd. Ord. TO-2021-17, 12-14-2021; Ord. TO-2022-13, 9-13-2022)
