3-3-10: ABANDONED, INOPERABLE VEHICLES:
   A.   Inoperable Motor Vehicle Defined:
      1.   “Inoperable motor vehicle” means any motor vehicle from which, for a period of at least seven (7) days or any longer period of time fixed by ordinance, the engine, wheels or other parts have been removed, or on which the engine, wheels or other parts have been altered, damaged or otherwise so treated that the vehicle is incapable of being driven under its own motor power.
      2.   “Inoperable motor vehicle” shall not include a motor vehicle which has been rendered temporarily incapable of being driven under its own motor power in order to perform ordinary service or repair operations.
   B.   Nuisance Declared: The Highway Commissioner hereby declares that inoperable vehicles on public ways under the jurisdiction of the Highway Commissioner to be a nuisance.
   C.   Notice to Remove: Whenever the Highway Commissioner or his/her designated agent sends a notice to the last owner of an inoperable vehicle located on a public way, as registered with the Secretary of State, to dispose of such inoperable vehicle, it shall be unlawful for such owner to permit said vehicle, or parts thereof, to remain upon the public ways after the passage of seven (7) days from the issuance of the notice by mail or personal delivery.
   D.   Removal by Enforcing Authorities; Costs: The Cook County Sheriff’s Office or the police department of any municipality located totally or partially within the Township are hereby authorized to remove or cause to be removed such inoperable motor vehicle or parts thereof. The reasonable cost of such removal shall be charged and paid by the registered owner of the inoperable motor vehicle upon the billing thereof.
   E.   Penalties: A fine of fifty dollars ($50.00) per day for each day that the registered owner fails to obey the notice of the Highway Commissioner and permits such inoperable vehicle, or parts thereof, to remain upon the public ways seven (7) days after such notice herein is made, shall be imposed upon such registered owner. Each day after the expiration of said seven (7) days shall be a separate offense. (Ord. HO-2022-1, 2-8-2022)
