1-1-5: DEFINITIONS:
KNOWINGLY: A person acts knowingly with respect to conduct or to a circumstance described by an ordinance defining an offense when he is aware of his conduct or that the circumstance exists. A person acts knowingly with respect to the result of conduct described by a statute defining an offense when he is aware that it is highly probable that such result will be caused by his conduct. When knowledge of the existence of a particular fact is an element of an offense, such knowledge is established if a person is aware of a high probability of its existence. Equivalent terms such as "knowing" or "with knowledge" have the same meaning.
NEGLIGENTLY: A person acts negligently with respect to a result or to a circumstance described by an ordinance defining an offense when he consciously disregards a risk that the result will occur or that the circumstance exists or when he disregards a risk of which he should be aware that the result will occur or that the circumstance exists. The risk must be of such a nature and degree that to disregard it involves a gross deviation from the standard of conduct that a reasonable person would observe in the actor's situation. "Gross deviation" means a deviation that is considerably greater than lack of ordinary care. Relevant terms such as "negligent" and "with negligence" have the same meaning.
OFFICER: Shall include officers and boards in charge of departments and the members of such boards, and such reference as use of the word "city" shall mean this municipality, "clerk" or "treasurer" and others shall mean the city clerk or city treasurer, as the case may be applicable.
OWNER: Applied to a building or land shall include any part owner, joint owner, tenant in common, joint tenant or lessee of the whole or of a part of such building or land.
PERSON: To include any person, firm, association or corporation, or any organization of any kind.
PERSONAL PROPERTY: Includes every description of money, goods, chattels, effects, evidence of rights in action, and all written instruments by which any pecuniary obligation, right or title to property is created, acknowledged, transferred, increased, defeated, discharged or diminished, and every right or interest therein.
PURPOSELY: A person acts purposely with respect to a result or to conduct described by an ordinance defining an offense if it is his conscious object to engage in that conduct or to cause that result. When a particular purpose is an element of an offense, the element is established although such purpose is conditional, unless the condition negatives the harm or evil sought to be prevented by the law defining the offense. Equivalent terms such as "purpose" and "with the purpose" have the same meaning.
STREETS: Includes alleys, lanes, courts, boulevards, public ways, public squares, public places, sidewalks, public parking areas, within the corporate limits of the city and contained within the limits of the Lewistown City-County airport.
TENANT OR OCCUPANT: Applied to a building or land shall include any person who occupies the whole or any part of such building or land whether alone or with others.

Words prohibiting anything being done, except in accordance with a license or permit or authority from a board or officer, shall be construed as giving such board or officer power to license or permit or authorize such thing to be done. (1961 Code)
If, in this code the term "wilfully" is used or found, such word shall be construed and interpreted in accordance with the definition of "purposely" as contained herein. (Ord. 1590, 10-1-1990)
