5-27-2: TEMPORARY CARRYOUT FOOD AND BEVERAGE STRUCTURES:
   (A)   An applicant for a temporary carryout food and beverage structure shall be required to obtain or provide proof of the following before commencing business:
      1.   A city business license.
      2.   Central Montana health district review/approval.
      3.   Planning department review/approval.
      4.   Fire department review/approval.
      5.   Building department review/approval, including any required building permits.
   (B)   The applicant must provide a scaled site plan showing the proposed location of the structure, pedestrian and any motorized traffic ingress/egress points and any changes to existing parking for adjacent structures. The applicant shall provide the dates when the structure shall be placed and removed from the proposed location, which period shall not exceed one hundred twenty (120) days.
   (C)   The structure shall not be situated on a public way. The structure shall not be located adjacent to a public way in a manner that interferes with pedestrian or vehicular traffic, parking or emergency access.
   (D)   The structure shall not be required to be connected to city water and sewer service. However the applicant shall:
      1.   Provide a written plan indicating where water will be obtained, where wastewater will be disposed of and, accessible sanitary facilities for all employees that is within two hundred feet (200') of the structure and accessible during all hours of operation.
      2.   Replenish water supply and dump wastewater daily in accordance with applicable health district or city regulations. (Ord. 1743, 7-16-2012)
