After any delinquency shall have continued sixty (60) days, the Treasurer may proceed in the Circuit Court of Greenbrier County to obtain an injunction restraining the further exercise of the privilege until full payment shall have been made of all tax, interest and penalty due under this article. In any proceeding under this section, upon judgment or decree of the municipality, the municipality shall be awarded its costs.
