(a) Any person, firm or corporation violating or failing to comply with any of the provisions of this article shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine in sum of not more than five hundred dollars ($500.00). In addition, the City may seek restitution for any destroyed or damaged tree.
(b) In addition to the remedies set forth in subsection (a) above, because of the uniqueness of each public tree and the irreparable harm to the public health and general welfare which may be caused by the destruction or damage to a public tree, the City shall be entitled to enjoin any person or entity who seeks to destroy or damage any public tree, or who is in the process of destroying or damaging a public tree.
