Notwithstanding the provisions of sections 7-13-3 and 7-13-4 of this chapter, the owner of a lot, lots or portions of a lot adjacent to or fronting on any portion of a sidewalk area shall not be required to repair any defective sidewalk if its condition was caused by a City planted and maintained tree in any street, right-of-way, park or other public place.
