ADOPTING ORDINANCE
ORDINANCE NO. 8905
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LEMOORE,
ADOPTING THE CITY CODE OF LEMOORE, CALIFORNIA
WHEREAS, the official ordinances of the City of Lemoore have heretofore been collected in binder form, both codified and uncodified, and entitled "Lemoore Municipal Code"; and
WHEREAS, Sterling Codifiers, Inc. has prepared an official and comprehensive codification of all of the ordinances adopted by the City Council of the City of Lemoore previously collected in the Lemoore Municipal Code; and
WHEREAS, the codification of the ordinances of the City of Lemoore has been gathered, printed and published in a code book entitled "City Code of Lemoore, California", which is incorporated herein by this reference; and
WHEREAS, official copies of the "City Code of Lemoore, California" is now on file with the office of the City Clerk; and
WHEREAS, On July 5, 1989, a noticed public hearing was held with respect to the adoption of this Ordinance, all in accordance with the provisions of California Government Code Section 50020, et seq.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lemoore, California, as follows:
SECTION 1: From and after the date of passage of this Ordinance, the City Code of the City of Lemoore, California, prepared by Sterling Codifiers, Inc., containing the compilation of all ordinances of a general nature together with the changes made to said ordinances, under the direction of the City Council of the City, shall be accepted in all courts without question as the Official Code and Law of the City as enacted by the City Council.
SECTION 2: There is hereby adopted, as a method of perpetual codification, the loose-leaf type of binding together with the continuous supplement service, provided by Sterling Codifiers, Inc., whereby each newly adopted ordinance of a general and permanent nature amending, altering, adding or deleting provisions of the Official City Code is identified by the proper heading or caption and is inserted in the proper place in each
of the official copies, three (3) copies of which shall be maintained in the office of the City Clerk, certified as to correctness and available for inspection at any and all times that said office is regularly open.
SECTION 3: All ordinances of a general nature included in this Official City Code shall be considered as a continuation of the said ordinances and their respective provisions and the adoption of this Ordinance and the Official City Code incorporated herein by reference shall not serve to cause any interruption in the continuous effectiveness of ordinances included in said Official City Code. All ordinances of a special nature, such as but not limited to tax levy ordinances, rezoning ordinances, franchises and vacating ordinances shall continue in full force and effect unless specifically repealed and amended by a provision of the City Code. Such ordinances are not intended to be included in the Official City Code. All ordinances of the City adopted following the commencement of the work of codification by Sterling Codifiers, Inc., and which are not yet included in the Official Code Book shall continue in full force and effect without interruption and shall be included in the Official Code Book in due course.
SECTION 4: It shall be unlawful for any person, firm or corporation to change or amend by additions or deletions, any part or portion of such Code, or to insert or delete pages or portions thereof, or to alter or tamper with such Code in any manner whatsoever which will cause the law of the City of Lemoore to be misrepresented thereby.
SECTION 5: All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.
SECTION 6: In accordance with the provisions of Government Code Section 36900 and Penal Code Section 19, any person violating any provision of this Ordinance or any provision of the Code adopted hereby shall be punished by a fine of not more than one thousand dollars ($1,000.00) or by imprisonment in the County jail for a period not exceeding six (6) months, or by both such fine and imprisonment.
SECTION 7: This Ordinance and the Code adopted hereby shall be in full force and effect from and after its passage and publication in accordance with law.
The foregoing Ordinance was introduced at a Regular Meeting of the City Council of the City of Lemoore held on the 6th day of June, 1989 and was passed and adopted at a Regular Meeting of the City Council held on the 5th day of July 1989 by the following vote:
