10-2-4: CRITERIA FOR REQUIRING CASH CONTRIBUTION IN LIEU OF SCHOOL SITE:
When the development is small and the resulting site is too small to be practical or when the available land is inappropriate for a school site, as recommended by the school district, the village shall require the subdivider or developer to pay a cash contribution in lieu of the land dedication required. Said cash contribution shall be paid to and held in trust by the school district solely for use in the acquisition of land for a school site to serve the immediate or future needs of children from that subdivision or development or for improvements to any existing school site which already serves such needs. Improvements under this section shall be liberally construed and shall include, but not be limited to, the development of parking lots; sidewalks; traffic signals; arterial streets; collector streets; internal roadways; connections with sewer, water and electrical lines; playgrounds; recreation grounds; and athletic fields. Improvements shall also include the purchase of any materials, goods or equipment necessary to said development and construction. Improvements shall further include the construction of buildings, additions to existing school buildings, remodeled or renovated instructional and noninstructional spaces in classrooms and purchase of prefabricated classroom units to be used at the school site.
   A.   Determination Of Land Value: The cash contribution in lieu of land dedication for school site shall be based on the fair market value of an acre of land in the area improved as specified in this chapter. It has been determined that the present fair market value of such improved land in and surrounding the village is thirty five thousand dollars ($35,000.00) per acre. The land value shall be used in making any calculation in this chapter unless the subdivider or developer files a written objection thereto. In the event of any such objection, the subdivider or developer, at his/her own cost, shall obtain and submit an independent appraisal from an MAI designated appraiser indicating the fair market value of such improved land in the area of the proposed development. Final determination of said fair market value per acre of such improved land shall be made by the village council in its sole discretion based on such information submitted by the subdivider or developer and from other sources which may be submitted to the village council by the school district or others.    B.   Alternate Cash Contribution Per Lot: In order that subdividers and developers for property situated within the village limits or within the one and one-half (11/2) mile area in LaSalle County and contiguous to the village and thereby subject to this chapter shall be assessed no more than subdividers and developers for property located outside of such area, but within Leland community unit school district no. 1 and thereby subject to the LaSalle County subdivision regulations ordinance adopted by the LaSalle County board, the cash contribution in lieu of land dedication shall be the lesser of the calculations set forth in subsection 10-2-1A of this chapter or the amount properly payable under the aforesaid county ordinance, which is currently six hundred dollars ($600.00) per platted lot.    C.   Time And Manner Of Payment: The cash contribution required herein shall be paid at the time of request for approval of a final plat of subdivision or planned unit development. No building permit shall be issued until said payment has been made. Payments hereunder shall be payable to the Leland community unit school district no. 1, shall be received by the village clerk and shall be immediately remitted to the Leland community unit school district no. 1.
   D.   Criteria For Requiring Dedication And Fee: There will be situations in subdivisions or planned unit developments when a combination of land dedication and a contribution in lieu of land are both necessary. These occasions will arise when:
      1.   Only a portion of the land to be developed is proposed as the location for a school site. That portion of the land within the subdivision falling within the school location shall be dedicated as a site as aforesaid, and a cash contribution in lieu thereof shall be required for any additional land that would have to be dedicated.
      2.   A major part of the school site has already been acquired and only a small portion of land is needed from the development to complete the site. The remaining portions shall be required by dedication, and a cash contribution in lieu thereof shall be required. (Ord. 26-96, 8-6-1996)
