§ 61.999 PENALTY.
   (A)   Civil fines. The Superintendent may impose civil fines on industrial users upon proper notice of continued non-compliance with the provisions of this chapter. Fines shall not exceed $1,000 per day per violation. The Superintendent may take appropriate action by assessment, addition to utility bill or attachment of lien in order to collect said fine.
   (B)   Any industrial user who willfully or negligently violates any provision of this chapter for which no penalty is otherwise provided, or any orders or permits issued hereunder shall, upon conviction, be guilty of a misdemeanor, punishable by a fine not to exceed $1,000,000 per violation per day or imprisonment for not more than one year or both. In the event of a second conviction, the user shall be punishable by a fine not to exceed $3,000,000 per violation per day or imprisonment for not more than 3 years or both.
   (C)   Whoever violates any provision of § 61.003 shall upon conviction be, punished by a fine of not more than $1,000,000 per violation per day or imprisonment for not more than one year or both. In the event of a second conviction, the user shall be punishable by a fine not to exceed $3,000,000 per violation per day or imprisonment for not more than 3 years or both.

   (D)   Whoever violates any provision of §§ 61.115 through 61.119 shall be fined not more than $1,000 for each offense or violation.
