§ 93.40 DIGGING, CUTTING AND EXCAVATING.
   It shall be unlawful for any person, firm or corporation to do, or cause or permit, any digging, cutting or excavating in any street, alley or public place, into or through any pavement thereon in the town; except that, a permit shall first have been secured upon written application to the Council, and a bond filed or deposit made in an amount determined by the Trustees to be sufficient, which bond or deposit shall be conditioned for saving the said town harmless from any loss, cost or damage by reason of such work, and conditioned that should settling occur within six months of the time such work was completed, excavations filled and pavement repaired, that the paving shall be removed, repaired and replaced, at the expense of the person securing such permit.
