§ 920.21 RIGHT TO ENTER AND INSPECT.
   (A)   The City of Lebanon or its designed agent may enter upon any lot or parcel of land within the City of Lebanon or any parcel which discharges into the City of Lebanon MS4 to inspect storm water detention or storm water quality BMPs or to investigate any reports of illicit discharges or pollution.
      (1)   When any new storm water quantity provision or storm water quality BMP is installed on private property, the property owner shall grant to the City of Lebanon or its designed agent the right to enter the property at reasonable times and in a reasonable manner for the purpose of inspection.
      (2)   This includes the right to enter a property when the City of Lebanon or its designated agent has a reasonable basis to believe that a violation of this chapter is occurring or has occurred, and to enter when necessary for abatement of a public nuisance or correction of a violation of this chapter.
   (B)   In the event the owner or occupant refuses entry after a request to enter and inspect has been made, the city is hereby empowered to seek assistance from any court of competent jurisdiction in obtaining such entry.
