§ 917.02 PRIVATE SOLID WASTE COLLECTION.
   (A)   The collection, removal and transportation of solid waste for resale or financial gain from recycling containers on the streets of the city shall be unlawful except for a person holding a license to do so or by employees of the city. All residential solid waste shall be handled and collected by the contractor currently under contract with the city to provide such services.
   (B)   Licenses for the private collection, removal and transportation of solid waste generated by non-residential properties may be issued by the City Manager upon application by the private interest. Licenses shall be issued for the calendar year at a charge of $50 per year or part thereof. The application shall include, but not be limited to the following information:
      (1)   The name and address of the owner of the business which is to remove such solid waste.
      (2)   The address of the location(s) where the accumulation of solid waste is to be picked up.
      (3)   A complete description of the vehicle(s) to be used for transporting the solid waste.
      (4)   The location and manner in which the ultimate disposition is to be made of such solid waste.
   (C)   No license shall be issued to any person for the private collection, removal or disposal of solid waste until such person has filed with the city his or her good and sufficient bond in the sum of $10,000 conditioned upon indemnifying the city from any damage that may be suffered by the city in any manner by reason of the issuance of such permit, the use of the city streets or the negligence of the license holder or any of his or her agents or employees. Such bond shall be in the form and manner as shall be approved by the City Attorney.
   (D)   The license holder will have to maintain in effect at all times public liability insurance in the minimum amounts of $100,000 for injuries to any one person, $300,000 for personal injury arising out of one occurrence and $25,000 property damage and to furnish the city a certificate evidencing this insurance.
   (E)   All persons holding a license for the private collection, removal or disposal of solid waste generated by non-residential properties shall comply with all regulations and requirements promulgated by the Director of Service. Failure to do so may result in the revocation of such license.
