§ 901.02 PERMIT REQUIREMENTS.
   (A)   No person shall make an excavation in any street within the city except in accordance with this chapter.
   (B)   Any person desiring to make an excavation in any street shall make application on a form to be provided by the city and shall furnish such information as is necessary to complete the application form, and such other information as the Director of Service may require.
   (C)   No excavation shall be made in any street unless and until a permit therefor has been issued by the Director of Service, except as otherwise provided in this chapter.
   (D)   The Director of Service may issue an annual blanket permit for the purpose of excavating within the streets in the city to the following:
      (1)   A public utility regulated by the Public Utilities Commission of the state.
      (2)   A person holding a franchise from the city.
   (E)   The Division of Water and Wastewater and the Division of Electricity shall not be required to obtain a permit. However, these divisions shall be required to comply with the regulations applicable to the excavations which they may make. When backfill or replacement of pavement or other work is performed by the Divisions of Street Maintenance in connection with a street excavation occasioned by the Divisions of Water and Sanitary Sewerage or Electricity, the cost of such work shall be paid from the appropriate fund to the Street Fund.
   (F)   The requirements of this chapter shall not be applicable in the case of a contract between a person and the city.
