Any matters arising under this chapter or any franchise granted under the authority of the chapter which cannot be resolved to the satisfaction of both parties shall be determined by a panel of three arbitrators. One arbitrator shall be appointed by the Mayor of the city, one by the grantee, and one by the presiding Judge of the Warren County Court of Common Pleas. The fees of arbitrators shall be determined by the presiding Judge. The expenses of the arbitration, including the fees of the arbitrators, shall be borne by the parties in such manner as the arbitrators provide in their award, but in no event will the city be obligated for more than half of the expense. The determination of the majority of the arbitrators shall be binding on the parties.
