§ 1501.02 MODIFICATIONS TO THE BOCA NATIONAL FIRE CODE.
   (A)   Delete BOCA National Fire Code section F-100.1 and replace with the following section F-100.1:
      F-100.1 The regulations as set forth herein shall be known as the Lebanon Fire Code and herein referred to as such or as “this Code.”
   (B)   Add section F-101.2.1:
      F-101.2.1 CONTRADICTORY PROVISIONS. When any provision of this Code is found to be in conflict with any other provision of this Code, the provision which establishes the higher standard for the promotion and protection of the safety and welfare of the public shall prevail.
   (C)   Add section F-102.3.1:
      F-102.3.1 AUTHORITY AT FIRES AND EMERGENCIES. The Fire Chief or his or her authorized representative shall be in charge at the scene of a fire or other emergency involving the protection of life and/or property, and shall remain in charge until authority is relinquished.
   (D)   Add section F-102.7.1:
      F-102.7.1 MODIFICATION. The Code Official may modify the application of any provision of this Code upon application in writing by the owner or lessee or his or her authorized agent, when there are practical difficulties that prevent the strict application of this Code and require an alternate procedure, provided that the spirit of the Code shall be observed, public safety secured, and substantial justice done. The particulars of such modification when granted or allowed and the decision of the Code Official shall be entered upon the records of the Code Official and a signed copy shall be furnished to the applicant.
   (E)   Delete section F-104.2.1 and replace with following section F-104.2.1:
      F-104.2.1 QUALIFICATIONS OF MEMBERS. Each member of the Fire Code Board of Appeals shall be a licensed professional engineer or architect or a builder or superintendent of building construction or a fire safety inspector certified by the State of Ohio. Each member shall have at least ten years experience in their respective fields as such with the exception of the fire safety inspectors who shall have at least three years of experience. At least one of the professional engineers on the board shall be a practicing structural or civil engineer.
   (F)   Add section F-105.3.3:
      F-105.3.3 PROCEDURE IN EVENT OF FIRE. In the event of an unfriendly fire, as defined by Ohio law, in any building or premise, the responsible person, as defined by state law, shall notify the Fire Division concerning the fire, and shall spread an alarm, immediately, to all occupants of the building or premises.
   (G)   Add section 105.3.4:
      F-105.3.4 FIRE DAMAGED STRUCTURES. Any building, grounds or structure that has been damaged by fire shall be secured from tampering or trespass and maintained in a nuisance free condition by the owner or his or her agent, in a manner acceptable to the Code Official. All structures damaged by fire or explosion shall have repairs under way or the structure shall be demolished or torn down, with all fire debris removed within 90 days after being damaged by fire or explosion. Exception: Structures involved in suspicious or arson fires and deemed as evidence by the Code Official.
   (H)   Delete section F-105.4 and replace with following section F-105.4:
      F-105.4 NOTICE OF VIOLATION. Whenever the Code Official observes an actual or apparent violation of this Code or any other code, ordinance, law or regulation under his or her jurisdiction, he or she shall seek corrective action by:
         (A)   Preparing a written notice of violation which shall describe the violation and establish time limits for correction. The written notice shall be served personally upon the owner, his or her authorized agent or person in custody of the premises or by regular mail to the last known address of the owner. As an alternative to the foregoing procedure a copy of the notice may be posted at any entrance to the property.
         (B)   Preparing and filing a complaint with a court of competent jurisdiction in the event the aforementioned notice of violation is not obeyed.
   (I)   Delete section F-105.5.1 and replace with § 1501.99 of this Code.
   (J)   Add section F-105.6:
      F-105.6 STOP WORK ORDER. Upon written notice from the Code Official that work on any building or structure is being performed contrary to law or in an unsafe or dangerous manner, such work shall be immediately stopped. A stop work order shall be given to the owner of the property involved, or the owners agent, or the person doing the work, and the order shall state the conditions under which work may be resumed.
   (K)   Add section F-105.6.1:
      F-105.6.1 UNLAWFUL CONTINUANCE. No person may continue work in or about a structure after having been served a stop work order, except such work as may be directed to be performed to remove the violation or unsafe condition.
   (L)   Add section F-105.7:
      F-105.7 POSTING OF ORDERS. The Code Official may require that any order or notice issued under this Code be posted by the responsible person, owner, or agent of the premises at or near the main entrance or lobby to such premises where the violation or violations are located.
   (M)   Add section F-105.7.1:
      F-105.7.1 UNLAWFUL REMOVAL. The owner, agent, occupant or other responsible person responsible for the premises under violation shall be responsible for maintaining the order or notice in the posted location until the entire order or notice has been cleared by the Code Official. Removal of a posted order or notice until cleared by the Code Official is prohibited.
   (N)   Add section F-106.1:
      F-106.1 DRIVING OVER UNPROTECTED FIRE HOSE. No vehicle shall, without the consent of the fire official in command, be driven over any unprotected fire hose.
   (O)   Add section F-106.2:
      F-106.2 FIRE DRILLS-GENERAL. Fire drills shall be held in buildings and all parts thereof, when of educational or institutional use, and such other occupancies equipped with a signaling system complying with the provisions of NFiPA 72A listed in Appendix A of this Code, and required to have been installed by this Code.
   (P)   Add section F-106.2.1:
      F-106.2.1 FREQUENCY. At least once a month in educational occupancies and at least once every three months on each work shift in institutional occupancies, and at least once every three months in such other occupancies equipped with a signaling system complying with the provisions of NFiPA 72A listed in Appendix A of this Code.
   (Q)   Add section 106.2.2:
      F-106.2.2 RECORDS. A record of all fire drills shall be kept on the premises and persons in charge of such occupancies shall make such record available to the Code Official which should detail time of drill, date of drill, weather conditions at the time of the drill, approximate number of persons drilled, and any other relevant information.
   (R)   Add section 313.4:
      F-313.4 ENFORCEMENT. The members of the Lebanon Division of Police and members of the Lebanon Division of Fire may enforce the parking restrictions concerning fire lanes anytime they observe a violation. Members of the Fire Division with this enforcement power is limited to Certified Fire Safety Inspectors.
   (S)   Add section 502.1.1:
      F-502.1.1 FIRE PROTECTION AND FIREFIGHTING EQUIPMENT. No person shall sell, offer for sale, or use any fire protection or firefighting equipment which does not meet the minimum standards for such equipment as specified in the building code, law, or this Code. Except for public and private mobile fire trucks, no person shall engage in the business of servicing, testing, repairing, or installing fire protection equipment for profit, without first being certified as required by law.
   (T)   Delete entire article 27 and replace with current state law concerning fireworks.
   (U)   Add section 2804.1.2:
      F-2804.1.2 UNDERGROUND STORAGE TANKS ANCHORING. All underground storage tanks for flammable or combustible liquids must be anchored to an eight-inch concrete base slab, which shall extend twelve inches beyond the outline of tank. All anchoring must be in accordance with the manufacturer’s requirements unless amended by this Code.
   (V)   Delete section 2908.1.1 and replace with following sections F-2908.1.1, F-2908.1.2, and F-2908.1.3 which are the same as city ordinances 339.04(C), 339.06 and 351.14
      F-2908.1.1 (339.04(C)) DUTY TO USE STATE OR TRUCK ROUTES. The operator of a vehicle carrying explosives or hazardous materials as defined by the Public Utilities Commission of Ohio or the United States Department of Transportation regulations shall remain on the streets and highways designated as truck routes, except for deliveries. The operator of a vehicle carrying explosives or hazardous materials may deliver or pickup property at those places located off truck routes provided such vehicles are operated to affect the least amount of travel possible on such streets.
      F-2908.1.2 (339.06) VEHICLES TRANSPORTING EXPLOSIVE MATERIALS OR HAZARDOUS MATERIALS. Any person operating any vehicle transporting explosives or hazardous materials shall at all time comply with the following:
         (A)   Each vehicle shall be marked or placarded in accordance with regulations or rules established by the Public Utilities Commission of Ohio or the United States Department of Transportation, which ever requires the higher standard of care.
         (B)   Each vehicle shall be provided with at least one portable fire extinguisher having a rating of not less than 2A-20BC.
      F-2908.1.3 (351.14) PARKING OF VEHICLES CONTAINING EXPLOSIVES OR HAZARDOUS MATERIALS. Vehicles containing explosives or hazardous materials shall not be parked in the city except during delivery of their load. During any delivery the vehicle must be attended at all times.
   (W)   Add Standard 3.08 Kerosene Heaters:
      STANDARD #3.08 (1988) KEROSENE HEATERS
      3.08.1 SCOPE. The provisions of this standard shall apply to all unvented kerosene heaters exempted from division A of § 3701.82 of the Ohio Revised Code when used in assembly, business, high hazard, institutional, mercantile, or R-1 and R-2 residential buildings, as defined by building code listed in Appendix A of the Fire Code.
      3.08.2 GENERAL. The use of unvented kerosene heaters in the aforementioned buildings and the storage of fuel for such heaters, shall comply with the requirements of this standard.
      3.08.2.1 PROHIBITED USE. Unvented kerosene heaters shall not be operated in any structure utilized for assembly, high hazard, educational, institutional, day care centers or facilities used for servicing or repair of motor vehicles, transient residential dwelling units.
      3.08.3 MEANS OF EGRESS. No unvented kerosene heater shall be located in any building means of egress, as defined by the building code listed in appendix A of the Fire Code.
      3.08.4 ELEVATION. An unvented kerosene heater shall not be elevated by being placed upon any stand or otherwise placed or suspended above the floor.
      3.08.5 COMBUSTIBLE CLEARANCE. An unvented kerosene heater shall not be placed within three feet of any furniture, drapery, curtain, decorative material, accessory, appliance, equipment, merchandise, goods, fixture, or other such device which is, or may be, combustible.
      3.08.6 ATTENDED. An unvented kerosene heater shall not be left unattended while it is operating.
      3.08.7 MAT OR BASE. Every unvented kerosene heater shall be set and centered upon a non-combustible mat or shallow base, three feet of mat or base to extend outward, in all directions, from any part of the unvented kerosene heater.
      3.08.8 FUELING. Every unvented kerosene heater shall be fueled, or re-fueled, strictly in accordance with the instructions of its manufacturer.
      3.08.8.1 REFUELING. An unvented kerosene heater shall not be fueled or re-fueled, while it is in operation or within ten minutes of flame extinguishment, or contrary to the operating instructions of its manufacturer.
      3.08.8.2 LOCATIONS. An unvented kerosene heater, or its fuel reservoir, shall not be fueled, or re-fueled, inside a building. All such fueling operations shall be performed outdoors.
      3.08.9 FUEL. The fuel used in every unvented kerosene heater shall only be number 1-K grade kerosene, as designated in section 1301:7-5-15 of the Ohio Administrative Code. The mixing of number 1-K grade kerosene with any other fuel or additives prohibited.
      3.08.10 FUEL STORAGE. All storage of kerosene shall be in approved containers or tanks as required by the Fire Code. The fuel used in every unvented kerosene heater shall be stored away from occupied areas.
      3.08.11 FUEL LABELING. Kerosene shall be stored in an approved container(s) which shall be marked or labeled in a conspicuous manner to read “1-K KEROSENE.” The use of red containers for 1-K kerosene is prohibited.
      3.08.12 FIRE PROTECTION. At least one portable fire extinguisher with a minimum Underwriters Laboratory Inc., classification rating of 2-A:20-BC shall be provided and available for use no closer than five nor greater than 25 feet from every operating unvented kerosene heater.
      3.08.13 DISPLAY REQUIREMENTS. A permit shall be obtained from the Code Official prior to any display or attempt to promote the sale of an unvented kerosene heater where such heater is displayed or promoted while operating.
      3.08.13.1 GUARDING. All displayed operating unvented kerosene heaters shall be protected from accidental contact by a substantial shield or guard.
      3.08.13.2 HEATER OPERATION. An unvented kerosene heater shall not be placed within 50 feet of any area that may contain flammable vapors, or storage of such material that may emit flammable vapors, while such heater is operating.
      3.08.14 APPROVAL. No person, firm, group, organization, or business shall sell, or offer for sale, any unvented kerosene heater exempt from section 3701.82 of the Ohio Revised Code, unless the unit bears the label of a nationally recognized testing laboratory.
   (X)   Add Standard 3.13:
   STANDARD #3.13 (1988) - FIRE DIVISION ACCESS
      3.13.1 SCOPE. This standard shall apply to all premises which the Fire Division may be called upon to protect. Suitable gates, access roads, and fire lanes shall be provided so that all buildings on the premises are accessible to emergency vehicles.
      3.13.2 RESTRICTED ACCESS. When access to or within a structure or an area is unduly difficult because of secured openings or where immediate access is necessary for lifesaving or firefighting purposes, the Code Official may require a key box be installed in an accessible location. The key box shall be of a type approved by the Code Official and shall contain keys to gain necessary access as required by the Code Official.
      3.13.3 HEIGHT AND SETBACK. Fire lanes shall be required by the Code Official for all building which are set back more than 150 feet from a public road, or exceed 30 feet in height and are set back more than 50 feet from a public road.
      3.13.4 SIGNS. Fire lanes shall be posted at a maximum of every 75 feet with an approved sign capable of being seen from the direction of travel.
      3.13.4.1 SIGN DESIGN. Signs for the posting of fire lanes shall conform to Ohio Department of Transportation sign regulations and standards for parking control zones as contained in the Ohio Manual of Uniform Traffic Control Devices.
      3.13.5 NOTIFICATION. The property owner shall provide a drawing of any proposed fire lane during the site plan review process pursuant to § 1135.26 of the Codified Ordinances of Lebanon.
   (Y)   Add Standard 4.04:
   STANDARD #4.04 (1988) - RESIDENTIAL SMOKE DETECTORS
      4.04.1 SCOPE. All residential structures shall be provided with an automatic means of detecting the presence of fire and notifying the occupants in danger of such fire. Protection shall be in accordance with the requirements of the Fire Code, and such detail requirements of this standard.
      4.04.2 DEFINITIONS. Residential occupancies and terms used within this standard are the same as those set forth in the Fire Code, and the building code listed in appendix A of the Fire Code.
      4.04.3 GENERAL. All residential uses shall be provided with smoke detection in the sleeping area, guest room or suite of a hotel room, motel, lodging house, or residential multi-family dwelling unit. Each detector shall be installed in accordance with NFiPA 72E of NFiPA 74 listed in appendix A of the Fire Code. When activated, the smoke detector shall provide an alarm suitable to warn the occupants within the individual room or unit.
      4.04.3.1 EXIT STAIRWAY. Multiple family dwelling units two or more stories in height and having only one common means of egress shall be provided with at least one hundred ten (110) volt single station detector at the toe of the stairway.
      4.04.4 RESPONSIBILITY. It shall be the responsibility of each property owner to provide the equipment and devices required by this standard and to properly maintain such equipment and devices. It shall be the responsibility of the occupant of all non-transient occupancies to maintain the battery of the smoke detector(s) within their respective control so that the detectors shall be operational at all times.
      4.04.5 TAMPERING. No person shall deface, remove, alter, damage, destroy or otherwise tamper with any smoke detector or any part of such system providing smoke detection protection that could cause any malfunction, defect, or other improper alarm to be transmitted or prevented from being transmitted when necessary. Persons duly authorized to perform service or maintenance work shall notify the Code Official when working on an automatic fire alarm system, and should make such notification when working on any other type of detection system.

   (Z)   Add Standard 5.01:
   STANDARD #5.01 FIRE SAFETY DURING CONSTRUCTION, ALTERATION AND DEMOLITION
      5.01.1 GENERAL. This section shall apply to all structures under construction, alteration or demolition.
      5.01.2 FIRE DIVISION ACCESS. Fire Department access shall be provided and maintained to all structures undergoing construction, alteration and demolition. Fire Division access roadways shall be of an approved surface material capable of providing emergency vehicle access and support at all times, and shall be a minimum of 18 feet in unobstructed width. The access roadways shall provide a minimum turning radii capable of accommodating the largest fire apparatus of the jurisdiction and a minimum vertical clearance of 13 feet 6 inches.
      501.2.1 TEMPORARY ROADWAYS. Where approved by the code official, temporary fire department access roadways of such a surface, width, turning radii and vertical clearance width as will permit access by fire apparatus shall be allowed until permanent roads are constructed.
      501.2.2 NEW SUBDIVISION STREETS. All streets or alleys not dedicated that provide access to buildings under construction, alteration or demolition are declared to be Fire Lanes.
      5.01.3 FIRE-FIGHTING ACCESS. Where required by the code official, temporary access to a structure for the purpose of fire-fighting shall beprovided. Construction materials shall not block any temporary fire-fighting access required by the code official, or access to fire hydrants and fire department connections.
      5.01.4 EGRESS. Required means of egress in occupied structures shall be maintained, or approved alternative facilities shall be provided during construction, alteration or demolition.
      5.01.5 PORTABLE FIRE EXTINGUISHERS. All structures under construction, alteration or demolition shall be provided with not less than one approved fire extinguisher at each stairway on all floor levels where combustible materials have accumulated. An approved portable fire extinguisher shall be provided in every storage and construction shed, the code official shall require additional approved portable fire extinguishers where special hazards, such as flammable or combustible liquid storage hazards exist.
      5.01.6 FIRE DEPARTMENT STANDPIPE SYSTEMS. The standpipe system shall be carried up with each floor and installed and ready for utilization as each floor progresses as required by the building code. Standpipes shall be extended as construction progresses to within one floor of the highest point of construction having secured decking or flooring.
      5.01.6.1 DEMOLITION. When a structure is being demolished and a standpipe or sprinkler system exists within said structure, such standpipe or sprinkler system shall be maintained in an operable condition so as to be available for utilization by the fire department. Such standpipe or sprinkler system shall be demolished with the structure, but the system shall not be demolished more than one floor below the floor being demolished.
      5.01.7 TEMPORARY HEATING DEVICES. Temporary heating devices shall be inaccordance with the mechanical code and the Lebanon Fire Code."
