§ 1306.09 AWNINGS.
   (A)   Permit required. A permit shall be obtained from the Building Inspector for the erection, repair or replacement of any fixed awning or hood except as provided in division (B) below, and for any retractable awning located at the first story level and extending over the public street or over any portion of a court or yard beside a building serving as a passage from a required exitway or exitway discharge to a public street.
   (B)   Exemption from permit. No permit shall be required for the erection, repair or replacement of fixed or retractable awnings installed on one-, two- and three-family dwellings, unless they project over public property, or for retractable awnings installed above the first story or where the awning does not project over the public street or over any court or yard service as a passage from a required exitway to a public street.
   (C)   Installation of awnings.
      (1)   Retractable awnings. There shall be a minimum clearance of seven feet from the sidewalk to the lowest part of the framework or any fixed portion of any retractable awning, except that the bottom of the valance of canvas awnings may extend to six feet, nine inches above the sidewalk. Retractable awnings shall be securely fastened to the building and shall not extend closer than two feet from the curb line or more than eight feet from the building. They shall be equipped with a mechanism or device for raising and holding the awning in a retracted or closed position against the face of the building.
      (2)   Fixed or permanent awnings. The clearance from the sidewalk to the lowest part of any fixed or permanent awning shall be seven feet. Fixed or permanent awnings installed above the first story shall not project more than four feet.
   (D)   Construction. Canopies or awnings shall be constructed of a metal framework, with an approved covering, attached to the building at the inner end and supported at the outer end by not more than two stanchions with braces anchored in an approved manner and placed not less than two feet in from the curb line. The horizontal portion of the framework shall be not less than eight feet nor more than 12 feet above the sidewalk and the clearance between the covering or valance and the sidewalk shall be not less than seven feet. The width of canopies shall not exceed eight feet. The height above the sidewalk may be increased and the distance which an awning or canopy may extend out from a building may be decreased when necessary to assure traffic and pedestrian safety.
