§ 4.11  CENTRAL BUSINESS (CB).
   (A)   District intent.  The CB (Central Business) zoning district covers the central business district of the city. Its intent is to protect the unique historic character of the downtown area while establishing the district as a specialty business, residential and shopping district. This District is further intended to permit the development of traditional mixed-use which would include second story residential above commercial. This District should be protected from non-neighborhood serving land uses such as “big box” or other more regional retail uses.
   (B)   Permitted uses.
      (1)   Residential.
         (a)   Dwelling secondary (on upper floors of first-floor retail/office use);
         (b)   Dwelling single-family (including manufactured homes);*
         (c)   Dwelling two-family;*
         (d)   Assisted living facility;
         (e)   Nursing/convalescent home; and
         (f)   Retirement facility (senior housing).
      (2)   Transportation services.
         (a)   Auto parts sales (without on-site repair); and
         (b)   Automobile/motorcycle sales area and leasing (open).
      (3)   Communications/utilities.  Utility company business office.
      (4)   Institutional/public uses.
         (a)   Community center;
         (b)   Fire station or police station;
         (c)   Government facility (non-office);
         (d)   Government office;
         (e)   Kindergarten or day nursery;
         (f)   Library;
         (g)   Museum or gallery; and
         (h)   Post office.
      (5)   Entertainment services.
         (a)   Banquet or assembly hall;
         (b)   Bowling alley;
         (c)   Dancing academy/martial arts/gymnastics studio;
         (d)   Lodge or private club;
         (e)   Miniature golf course;
         (f)   Retreat center;
         (g)   Skating rink (roller/ice);
         (h)   Swimming pool (private); and
         (i)   Theater (indoor), excluding adult motion picture theater and adult mini-motion picture theater.
      (6)   Professional services.
         (a)   Administrative/professional office;
         (b)   Bank/financial institution;
         (c)   Business/financial services office;
         (d)   Clinic (medical/dental) or health center;
         (e)   Conference center;
         (f)   Data processing/call center;
         (g)   Employment service;
         (h)   Hotel/motel;

      (7)   Retail/wholesale sales.
         (a)   Antique shop;

         (c)   Art or photo gallery;
         (d)   Auction facility (excluding livestock);
         (e)   Book store;
         (f)   Building finishes shop (paint, carpet, wallpaper and the like);
         (g)   Convenience store (without gas station);

         (k)   Garden shop/retail nursery;

         (a)   Barber shop;

         (c)   Child care/day care center;
         (d)   Dry cleaning establishment (retail);
         (e)   Fitness center;
         (f)   Funeral home;
         (g)   Health spa;
         (h)   Laundry (self-service);
         (i)   Massage therapy (by licensed massage therapist);

         (m)   Tailor and pressing shop; and
         (n)   Tanning salon.
   (C)   Conditional uses.
      (1)   Agriculture.  Farmer’s market (permanent).
      (2)   Residential.
         (a)   Bed and breakfast facility;
         (b)   Boarding house;
         (c)   Child day care home;
         (d)   Dwelling, accessory apartment (“granny flat”);
         (e)   Group home;
         (f)   Home occupation;
         (g)   Residential facility for the developmentally disabled type II; and
         (h)   Residential facility for the mentally ill.
      (3)   Transportation services.
         (a)   Automobile filling station;
         (b)   Automobile/motor vehicle repair, (minor), including oil changes/lubrications, brake replacement, muffler replacement, tire servicing, radiator cleaning and flushing, water hose replacement, windshield wipers and the like;
         (c)   Car wash;
         (d)   Motor bus or railroad passenger station; and
         (e)   Parking lot or structure (as a principal use).
      (4)   Park, recreation and natural areas.
         (a)   Artificial lake of three or more acres;
         (b)   Country club/golf course/driving range; and
         (c)   Park or recreational facility (playgrounds and athletic facilities).
      (5)   Communications/utilities.  Utility substation.
      (6)   Institutional/public uses.
         (a)   Church or temple;
         (b)   College building;
         (c)   Hospital;
         (d)   Institution for the developmentally disabled/mentally ill;
         (e)   School (any combination of K - 12), public and private;
         (f)   Trade or business school; and
         (g)   University or college.
      (7)   Entertainment services.
         (a)   Bar or tavern or night club;
         (b)   Billiard room or arcade;
         (c)   Recreational development (private);
         (d)   Swimming pool (public); and
         (e)   Winery.
      (8)   Retail/wholesale sales.
         (a)   Department store, including any facility (whether or not attached) associated with the department store for the sale of tires, batteries, automobile accessories and lubrication and for the servicing and repair of motor vehicles incidental to those sales; and
         (b)   Shopping center.

   (E)   Notes.
      (1)   A certificate (§ 9.12 Certificate of Compliance with Safety Codes) shall be required for change of tenant or use and conversions of residential to: commercial; multifamily; or dwellings with mixed-use occupancy.
      (2)   The Building or Fire Code Enforcement Official of the city shall have the authority to require or increase a fire-protection rating in any structural assembly of an approved multifamily dwelling or mixed-use occupancy that includes a residential occupancy.
      (3)   Development plan required.
