§ 100.17  POWERS AND DUTIES GENERALLY; BUDGET.
   (A)   The Board shall have all powers necessary to develop, maintain, preserve and operate all sites, facilities, programs and property, both real and personal as are generally understood to be park and recreation functions or facilities in the city. Acquisitions and/or additions to the public parks of the city shall be subject to the approval of the Board of Works. Ultimate disposition of park property, after its acquisition, shall remain the responsibility of the City Board of Parks and Recreation, it being the intent of the Park Board, the Board of Works and the fiscal body of the city that sound fiscal management is exercised with public funds and property. The Park Board shall have those powers and duties specifically set forth in I.C. 36-10-3-11, as if specifically set forth herein, excepting therefrom, the power of eminent domain which is specifically excluded in this adoption of I.C. 36-10-3.
   (B)   The Board shall prepare and submit an annual budget in the same manner as other departments of city government as prescribed by the State Board of Accounts. The Board may accept gifts, donations and subsidies for park and recreation purposes.
   (C)   So much of those portions of I.C. 36-10-3-20, 36-10-3-21 and 36-10-3-22 pertaining to non-reverting capital funds and cumulative building funds, and the taxing powers, if any, given by I.C. 36-10-3-27 are specifically omitted and excepted from the city’s adoption of I.C. 36-10-3 as the city has previously adopted Ordinance 84-21 allowing the receipting of proceeds and miscellaneous receipts into the special programs appropriation in the Parks Department and the same ordinance permits disbursement pursuant to the ordinance.
