§ 33.31  PURPOSE; ADMINISTRATION.
   (A)   The Board of Public Works and Safety of the City of Lebanon, Indiana shall serve as the board of directors and the governing body of the Stormwater Department and District in accordance with I.C. 8-1.5-5-1 et seq.
   (B)   Pursuant to I.C. 8-1.5-5(g)(2) and I.C. 8-1.5-3-3(a), the Board of Public Works and Safety is hereby directed to control the city's stormwater facilities and shall have all of the powers and responsibilities set forth in I.C. 8-1.5-3-4(a) and I.C. 8-1.5-5-6, and as otherwise provided by law or in equity.
   (C)   The Board of Public Works and Safety, with assistance from the City Engineer on behalf of the Stormwater Department, shall annually prepare and submit a budget to the Common Council for its approval, recommend to the Common Council reasonable and just rates and charges for services to utility patrons, and take such other actions as are required or permitted by law.
