§ 72.11  AUTHORITY OF BOARD OF PUBLIC WORKS AND SAFETY TO ESTABLISH PARKING RESTRICTIONS IN AREAS OTHER THAN DOWNTOWN TRAFFIC AREA.
   The Board of Public Works and Safety, as the traffic control authority for the city, shall be authorized to take the following actions regarding vehicle parking in areas other than the downtown traffic area.
   (A)   Whenever the owner of any business located outside the downtown traffic area, as defined by city ordinance, petitions the Board for restricted parking, the Board of Public Works and Safety may designate restricted two-hour parking adjacent to those businesses, where possible giving consideration to past and present traffic patterns and the general welfare and safety of the public in the area where restricted parking is requested. The area of restricted parking established by the Board of Public Works and Safety shall be bounded by appropriate signs designating restricted parking between these signs and shall include no more than two vehicular parking spaces. The same maximum duration of two hours shall apply to those spaces as is applicable to the downtown traffic area. For purposes of this section only, the word BUSINESS shall mean retail establishments, wholesale establishments, professional offices, insurance offices and real estate offices. The petition presented to the Board shall include notifications to, and acknowledgments by, surrounding property owners who may be affected by the granting of the a request. SURROUNDING shall be defined to mean residents within the block area on both sides of the street, where the business fronts or has its principal place of operation.
   (B)   Upon the restriction of parking as set forth herein, the Board of Public Works and Safety shall give appropriate notice by signs and markings setting forth the time restrictions established by this chapter; provided, however, the city shall be reimbursed by the owner(s) of the business(es) affected for the cost of implementing the request for restricted parking, including, but not limited to, signage, the marking expense of streets and curbs, and the costs of publication of the penal nature of the ordinance passed for purposes of enforcement.
   (C)   Enforcement of restricted parking outside of the downtown business area may be accomplished by complaint by any person filing in the City Court an affidavit setting forth the nature of the offense which occurs in any spaces allocated pursuant to this section.
