Nothing in this subchapter shall be construed as preventing any special agreement or arrangement between the utility and any user or person whereby wastewater of unusual strength or character is accepted into the sewage works and specially treated, and the user is subject to any payments or user charges, as maybe be applicable. However, no discharge which violates categorical pretreatment standards will be allowed under the terms of such special agreements. If, in the opinion of the utility, the wastewater may have the potential to cause or result in any of the following circumstances, no special agreement shall be made: pass-through or interference at the POTW; endanger municipal employees or the public; or cause violations of the city's NPDES permits or water quality standards in the receiving waters.
